ABC Financial Deceptive practice regarding automatic renewal Sherwood, Arkansas

Buyer Beware!!!!! My gym membership with Anytime Fitness expired in March 2011. As I referred a member who joined Anytime Fitness during my contract, my last checking account debit was waived (3/10/11). Signed onto my bank account today and viola'! There was a debit for $34.99 for my membership with Anytime Fitness on 4/10/11. Surprise, surprise. I Googled the financial company responsible for the debit, ABC Financial, and before I could even locate their website was shocked and the complaints filed regarding this company. I called member services, spoke with Carlos, questioned the 4/10/11 debit, Carlos said my membership doesn't expire until 4/28/11 and WILL THEN CONTINUE month-to-month until written cancelation is received within ABC Financial and THEN it will take 30 days to process that request. Funny thing is, I have already joined another gym, and guess who controls the debits? Right.....ABC Financial!! I said "so, my 3/10/11 debit did not occur since I referred a member who joined" as I was told my LAST DEBIT would be free, yet on 4/10/11 ANOTHER debit occured?? Odd. I also pointed out that since it takes 30 days to process my cancelation request that I felt sure ABC would debit my account again on 5/10/11 since today is 4/12/11 and Carlos confirmed this. The great thing is, I will be paying for two gym memberships, BOTH through ABC Financial. Awesome. Scam is an understatement. You get NO notifications via email, US Mail, NOTHING. My gym told me my last debit was 3/10/11, not 5/10/11. Had I have known they would continue to rob my bank account I would have NEVER signed a contract at the new gym using the same financial company. Needless to say, I will be faxing them today to cancel my "unauthorized, continued membership" as well as mailing a letter via regular US Mail AND Certified US Mail. I feel for the next consumer coming across this post as most people live paycheck-to-paycheck in today's economy and I cannot even begin to imagine the cost of NSF's that ABC Financial must cost it's members. Horrific way to do business. ABC Financial should be ashamed.

Most health clubs request a cancellation request be sent in writing. Your agreement should indicate the kind of notice that is to be given to discontinue service - most clubs ask for at least 30 days notice.

Regardless what most health clubs do, the practice is deceptive and misleading to consumers. I am certain you do not bring attention to this practice or most consumers would not sign authorizing such automatic withdrawals.

It's a common practice for a membership to continue at the end of the original term - much like a cell phone agreement, the service is not discontinued at the end of the allotted time frame, but continues until the consumer is no longer in need of the service.

We have had the same problem with ABC financial. I originally paid for the ATI gym membership for myself, my mom (who was visiting for 6 months) a friend (who was leaving for Pakistan in 6 months), and my two sons. I paid for all of these memberships with my own credit card, and I specifically asked the man who signed us up whether it would be easy to cancel my mom's and my friend's membership when the time came... we knew very well that both of them would be leaving town. I was assured that there would be no problem at all--"just let us know and their memberships will be canceled." What a lie! When the time came, I first sent an email asking to cancel the memberships. That was refused (although abc financial sent ME an email, NOT a letter, telling me that my email was unacceptable.) Then we sent a registered letter asking for the cancellation of the gym membership for my mother (who had returned to North Carolina), my son (who was no longer interested) and our friend who had returned to Pakistan.
ABC financial did not care in the least that I was paying for all three of these memberships with MY credit card. They wanted a letter from each individual, including our Pakistani friend who does not write English.
Sorry, but this is ridiculous. We finally sent in three separate certified letters, after which we were informed that it would be 30 days to cancel. Now, a month later, they have again charged our account for all three debits and in addition, a late charge for my son's account.
ABC financial is deceptive, vindictive, unaccessible and unethical. Be careful where you sign up for anything, and make sure that ABC financial is not behind the company. We are still not out of the woods! They are threatening to report us to a credit bureau in spite of the fact that our accounts are automatically deducted. Talk about the worst of all worlds.
