auto sale and repair baker abu-ata stolen our money and car west palm beach , Florida

I Raymond was referred by my mechanic makkeh auto to auto sales and repair with the dealer #VI10106921 (Baker Abu Ata). Who has a warehouse located at: 1118 25th street West Palm Beach fl 33407 (561) 577-4747. On April 4th. He took me and my friend(Mr. Shafiee) to auction to buy a car. That day he put a bit on Benz 2005 S500 (VIN#wdbng84jo5A456874) but he could not get it, later on I received a phone call from him and he told me he bought the car for $18,000.00 from auction, I told him since we just bought a car last month from you and price of the this car is out of my budget I won't be able to pay for it now. He told me why don't you put some money down since I'm a dealer I will finance the rest for you. On April 10th 2010 I gave Baker$2000.00 in cash and a company check #3209 dated 4/27/10 for $7000.00. Then on may 7th I gave him two other checks for the total amount of $3,000.00 (check#3243 and #3244 $1,500.00 each). Also in 06/21/2010 he received another check from me (check#3296 for the amount of $1,500.00) at the end we had a balance of $4,500.00 plus $700.00 his fees and tax, which he agreed to get paid by Jan 15th 2011. He had the title of the car in his position he let us to drive the car with his dealer tag until august 2010 that he transferred the registration to my wife's name.


About 2 weeks ago we received a phone call from oversea that My father in-law had a heart attack and he was going under the open-heart surgery on Mon 12/20/10. I called Baker and informed him I need to sell the car ASAP. He said he couldn't take car to auction but he would let us know if he would had a buyer for it, so I decided to put my car for consignment. I took my car to Foreign Affairs they asked me to sigh a contract and they do the rest, I called baker, He told me to bring the car over and he try to find a buyer with the good price for it. On thru Dec 16th I detailed the car and took the car to him in excellent (show room) condition.And he gave me a loner Volvo till sell the car. we received a call from him on Fri Dec 17th, that he mentioned he had a cousin in new jersey who is looking for a nice car so he is trying to sell the car to him. I asked him how much his cousin going to pay for it.He told me at least I would get you $18,000.00 or more. The next day on sat Dec 18th he called me as I was at work. He told me he sold the car for $18,000.00 and he wanted us to sign the title so he would be able to finish the transaction. Since my wife is the registered owner of the car I sent her to his shop. Baker took advantage of her and convinced her to sign the title of the car, without giving her any kind of payment. Also he mentioned since his cousin is living out of state she need to sigh the power of attorney, so he can finish the transaction and he said come and get the money on Monday.


On Mon Dec 20th around 1:00 o'clock we went there and expecting to get our money from him. He said I sold your car for $14,000.00 because I changed my mind!!! You will get only $3000.00 from that!!!!!!! You need to pay me $10,900.00 from your balance. We were very upset the way he took advantage from our situation. Also we saw that the car was in the warehouse. Then I told him I know that we have to pay remaining balance of $6,720.00($4500, tax and his fees) which you financed for us, but how did you come up with the amount of $10,900.00,by law I have a right to know that and you have to give us a receipt and bill of sale for it as well. He said that ?s the way it is. I have your signature and I own the car now you cannot do any thing.Also he mentioned: I have the another set of keys and since your wife sighed the title I am the owner of the car, then he ran out of his shop and got behind the wheel on Volvo and said you can walk now, you have nothing on me!!!! He tried to make a scene so he can call the police on us. I call Bret my driver and he gave us the lift. After that I went to see my mechanic at makkeh auto I complain to him about Baker and told him what he did to us. He said he will be a mediator and will solve the issue we met on wed in his mechanic shop. Baker was demanding that he wants the money for the amount of $10,900.00 in cash only in order to give us our car back and we asked him at least give us a receipt and bill of sale.And he refused to do that or did not provide any other finical paper works that shows he sold the car. He said once I give you the title that will be your receipt. At this point we are seeking for legal help. In last few days our business has been hurt, because we can not commute between our locations, my wife couldn't fly overseas to see her sick dad, and our Christmas holidays has been ruined. We are suffering emotionally and financially. At this Point I am look for compensation from Baker and his dealership, I would like to retrieve our irreparable losses from his company's bond.
