First Data FirstData, Can We Organize A Class-Action Lawsuit Against This Company? Simi Valley, California,

First Data has been the biggest nightmare of a company I have ever had to deal with! The people who run this company totally don't care anything about their customers, and here are the facts to support these statements: I was referred to First Data by a company, called LeadNetPro. According to LeadNetPro, they supposedly have an agreement with First Data, where the LeadNetPro members can join First Data on a month-to-month agreement, and for a $30 a month charge. I signed up with First Data on 2-4-11. Before I signed up, I asked the salesperson, by the name of Claiborne King, several times what my total monthly cost would be, and he told me $25 a month. I asked him if there would be any other monthly charges, and he said "no." Well, I was surprised when I received my initial bill from First Data, and the amount was $46.23. I called the company, and they told me this would be my monthly charge. Claiborne King was obviously dishonest with me so that he could make his greedy commission! Also, Claiborne King never mentioned the fact that there is a 6 month contract. If I had known that, I never would have signed up with First Data at all. When I called customer service to try to get a resolution to the problem, they refused to let me speak to anyone on the phone who would help me with my situation! Instead, they told me that I would have to file my complaint, via email, to their corporate office at this email address: [email protected]. In my initial email to corporate, on 3-4-11, I requested to be allowed to cancel my contract without having to pay the ridiculous $155 early termination penalty, since I wasn't aware I was signing a 6 month contract. I didn't see anything on the site that said there was a 6 month contract, so if that information was there, it must have been in very small print (not surprising that it was in small print, right?)! In my email to corporate, I also said that if the company would not honor my request to waive the $155 early cancellation fee, then I wanted them to terminate the employment of Claiborne King, the salesperson who lied to me about the cost and didn't tell me about the 6 month contract. Well, I FINALLY received a response from the corporate office today, but the response came exactly 3 weeks after the day I filed my original email complaint. THIS IS AN OUTRAGEOUS AMOUNT OF TIME TO HAVE TO WAIT FOR A RESPONSE! Not only did it take corporate 3 weeks to respond to my request, but when they finally did respond, they only sent me an email, with no phone number included. The email came from Cynthia Garcia, from the Business Solutions Group, First Data Independent Sales. In this email, Ms. Garcia basically said I signed a contract, and there was nothing they could do for me. After reading her response, it seems as though she didn't even bother to read my email at all! Also, from her response, it seems as though she doesn't care! She didn't bother addressing my issues at all! A while back, when I was speaking to a customer service person on the phone, this person told me the corporate office would probably call me and talk to me on the phone to help me resolve this
situation. Well, that certainly didn't turn out to be true! It seems that these people will say anything to get the customers off the phone! At First Data, it appears that there are no consequences for employees who deceive customers (for example, the salesperson who lied to me, who is still employed there), so why should their employees care what they say? If you can say whatever you want to the customers, and get away with it, why would you have any fear of anything? As if all of this wasn't enough, to add insult to injury, I faxed over an account cancellation request to First Data on 3-23-11. On that request, I clearly checked the box that said to cancel my account "Upon the end of the initial term of my agreement." Well, this means my account should have been canceled at the end of my 6 month contract. However, First Data shockingly went ahead and canceled my account immediately, and they said they will charge me the $155 early termination fee. This is more proof that the people at First Data apparently do not bother to even read any requests you send to them! I didn't ask to have my account canceled immediately, but they didn't care! They did it anyway. LET ME BEG YOU AND URGE YOU TO STAY FAR AWAY FROM FIRST DATA! It took me several hours to put this complaint together, but I did it in order to protect all of you guys who are considering using this company! Every single thing I have said is true, and I will put my hand on any Bible when I say it! It really angers and upsets me to see big corporations take advantage of the little guy the way this company does! There's power with the people, and I say it's time to stand together against First Data for the evil that they have done to innocent consumers!
