Heath Income Tax Heath and Haines Income Tax Admitted to Paid Tax Preparer Error for Prior Year and Refuse to Cover our Damages to IRS Cartersville, G

Heath's Income prepared our 2009 tax return. When my husband had our 2010 taxes done, he was surprised at the refund difference as we had received a larger refund the prior year. The tax preparer at Heath's, who prepared our 2010 taxes, stated that the prior years preparer had made a typographical error. She then jokingly implied to remain quiet about the error. We thought if the IRS contacts us about the error, Heaths carries insurance that will cover the mistake. I have now subsequently tried to find licenses on tax preparers at Heath's through GA Sec of State and cannot locate any. We received notice from IRS that we now owe thousands of dollars. We spoke to Heath's on a number of occasions. They have no voicemail, email, and rarely answer their phone. My husband spoke to a rep from Heath's and we were told Heath's would send us a check for the error. After receiving no check, we called again and were told that we in fact needed to pick up the check. The story at Heath's keeps changing. The paperwork and $175 check that only covers IRS interest were in a manilla folder as if it were to be mailed (our INCORRECT mailing address was listed on the front and they already had the return address as well). Heath's is refusing to cover the error after verbally admitting to the error a few times, stating we should remain quiet about the error (honest mistake they referred to it as). We understand an honest mistake (we think...), but it was their error. We paid them for a service and they did the service incorrectly and now say it is not their fault or responsibility. Heath's also stated that we paid a very low rate to have our taxes done, implying we should be grateful. We do not dictate their rates and paid what they asked us to pay. Now we are asking they correct their error as it has now hurt us financially. Heath's signed off on our 2009 taxes stating "they have reviewed the above taxpayer's return and that the entries are complete and correct to the best of my knowledge." We provided correct documentation and they submitted incorrect information.
