On January 17, 2011, I was purchasing a 2003 Saturn Vue from the Dealer at the Kaw Drive location where their salesman Jodi assisted with the sale. His selling point was the fact that there was a new transmission placed in the vehicle and that it was in grade A shape. Within this sale there was a 3,000 miles 30 day warranty plus I purchased an extended warranty from ASC Warranty on the vehicle. The company decided to finance me in house for the vehicle but then later on January 27, 2011 signed papers to finance the vehicle with Security Loans, Inc. On Tuesday, February 3, on my way to work the vehicle would not proceed to drive less than a mile from my destination. I had to call a co-worker for a ride into work and Sante Fe Tow Services to pick up the SUV and bring it to my job and Enterprise Rental so that I may have transportation to and from work for the rest of the week. Later that morning I called Jodi the sales rep and told him what happened to the vehicle and because of the bad weather no one was able to retrieve the vehicle. In the interim, I asked how I was going to be reimbursed for the tow and rental expenses and Jodi told me to call ASC the extended warranty service. When I called ASC they had informed me that I would have to get the truck to a mechanic and have them run a diagnostic in order to be reimbursed for the rental and tow. I informed Jodi of what they had said and he said the dealership will take care of it when they come and get the vehicle to have it fixed. On Thursday, February 4th while arriving to work I realized the truck was gone from my job. I did not know what was wrong with the truck and for several days heard nothing. I called ASC warranty to find out about submitting my receipts for reimbursement and they told me I could not because I had already maxed out my benefits for the year. I was confused on how I maxed out my benefits when I never was able to submit anything for reimbursement. I then called Jodi at the dealership who then told me to speak to Stephanie (the owner's daughter and manager of Hinton) to get reimbursement. I had also found out later that day after calling the warranty company back that Hinton Auto had sent the truck to Bakers Automotive of Overland Park and that is who ran the diagnostic on the truck. This was the first time within the whole ordeal that I knew the whereabouts of the truck. On 2/7/11 Stephanie told me to fax over my receipts and that she will talk to the owner regarding reimbursing me. On 2/8/11 I included a cover letter with the details of the conversation along with the receipts and faxed it to Stephanie's attention per her request. Later that day I had found out through ASC that Bakers Automotive had submitted a claim against my extended warranty for the maximum amount of 1000.00 and that because this was the maximum benefit amount that they would not be able to reimburse me for the rental and tow expenses. Tom the claims rep at ASC informed me that they were cutting the check and there was nothing I could do. I called Stephanie back and told her what the warranty company had said and she exclaimed that yes the mechanic was getting the 1000.00 from my warranty and that I would have to come out of pocket an additional 3,000.00 to get the truck fixed and that I would not be reimbursed for the rental or tow fees. Stephanie had also disclosed that the transmission in the truck was not new and that it was purchased over two summers ago so it did not carry a manufacturer's warranty as stated by Jodi the salesman who had made a selling point to say that it was just installed a new transmission. I contacted ASC back and asked if it is within their practice to let anyone submit a claim against a warranty if they are not the person listed on the warranty because that's exactly what Bakers Automotive had done. That I did not know who this mechanic was and that I wouldn't have known the location of the truck if it wasn't for ASC telling me where it was. I had called Brian the mechanic at Bakers Automotive and explained to him I was having the truck towed to my house and he said he was not releasing the vehicle because money was owed for service. No one was supposedly had touched the truck because one hand was waiting on the other hand and then Brian said that they worked on the truck. In the interim, Security Auto Loans was acting as mediator between Hinton and I because they were not going to release a check to the dealer for a vehicle that was not running. On 2/9/11 Tom from ASC called me back and said that there must have been a miscommunication because he wasn't aware that I did not know where the vehicle was located and that I did not know the mechanic and canceled the claim that Bakers Automotive submitted for payment. Also, Tom instructed me to fax over a copy of the rental and tow expenses and he will see if they would reimburse me for the two expenses. As of 2/10/11 I am awaiting an answer. 2/9/2011 Eric with Security Auto Loans informed me that Hinton had agreed to let me out of the deal because they refused to fix the vehicle at their expense and I refused to give their mechanic 3000.00 additional dollars to fix a transmission that Jodi the salesman had previously said was brand new and on a vehicle I had for only a couple of weeks that had a dealer's warranty and an extended warranty. I had to take the loss of the 1000.00 down payment and the 309.00 rental and 63.00 tow fee is still up in the air. Also, Eric had stated that Stephanie was willing to put something in writing stating that I was no longer liable for the vehicle and when Stephanie called she said if I come and sign an Involuntary Repossession form it would protect the both of us from this transaction. I refused because this was clearly not a repossession of any type.
