Jinny's Bridal dishonest, greedy, liars! Huntington Beach, California

Nightmare! After visiting their store on a few occasions shopping for a wedding dress I finally settled on a wedding dress. I was feeling a bit pressured to get a dress on order as the sales assistant mentioned several times that I really needed to get a dress ordered to avoid rush fees. I placed the required 70% deposit of $619.44 down on the dress and signed the receipt, on April 27th, 2011 at approx. As I drove home I cried all the way knowing that I was pressured and I didnt love the dress. When I got home (1 hours) I immediately called Jinnys and left a voicemail to not order the dress. The following afternoon the sales assistant young Marina (there are 2 Marinas) called me confirming they received my voicemail to not order the dress. I cried all the way home, I got home within 1 hours and immediately called Jinnys and left a voicemail canceling the order and that I would be back in the store to try on more dresses. The following morning I sent them flowers thanking them for the patience and customer service. That afternoon young Marina called me letting me know that they had received my message and put the order on hold. On May 2nd I went back to the store to look at more dresses and Marina (southern accent) was assisting me and had one dress pulled but I didnt like it. At this point Marina said that Ive tried on everything in the store. I then decided to go to another store and within 40 minutes I found the dress I wanted. I called Jinnys to let them know I found a dress and Marina immediately said you know there are no refunds. I then looked at my receipt and sure enough, at the bottom of the receipt it read No Refunds No Returns. Here is the approx. dialogue of our conversation ME: why didnt anyone point this out to me or mention it before I put the deposit down MARINA: because its right on the receipt. ME: but you didnt order the dress MARINA: but we did order the dress ME: how could that be, I canceled the dress within 1 hours of giving the deposit MARINA: you see, Jinny wakes up around 5:00am 6:00am and places the orders for the dresses, she didnt know you had canceled until after she got in the store the next day, we cant refund your money because weve already paid the manufacturer money to place the order.ME: so, would I still be able to use the deposit as credit in the store? MARINA: absolutely!..
My Fiance then contacted the store. They told him everything they told me and that the manufacturer has already pulled the fabric to make the dress and there was no way they could refund my money. On May 9th, 2011 I called to speak with the owner Jinny. I informed her that I felt pressured to order a dress and at the end of the day I settled for a dress I didnt love, literally had tears in my eyes as I was giving my deposit and canceled the order as soon as I got home, within 1 hours. I wanted to know what I could do to try and get at least most of my deposit backApprox. dialogueJINNY: theres nothing I can do, you signed a contract. ME: but you didnt order the dress JINNY: that doesnt matter, you signed a contract This was the jist of this conversation, she just continually said that I could have $619.44 in store credit and that I signed a contract. No mention of money going to the manufacturer and basically admitting they did not place the order for the dress. I finally told her that I guess my only option would be to order a different wedding dress to use up the credit and then turn around and sell it on eBay and take a loss.
On May 18th I called Jinnys to ask how much time I would have to use up the credit. I was talking with Marina, Dialogue: MARINAwell, I dont know, ME: but I need to know because I dont want to sit on this for a few months, then come and to find out that the credit has expired. MARINA:how about 30 days, how does that sound? ME:not good, I want to know what your actual policy is for store credits. Marina then put me on hold to ask Jinny and came back with 90 days. On May 22nd I went into Jinnys and talked with Jinny. Approx. dialogueME: Ive talked to an attorney and was counseled that I should take you to small claims court but honestly, I dont have time for this. And Ive seen you have 9 complaints filed with the BBB and many lengthy complaints on Yelp. Jinny went on about how the complaints with the BBB were resolved and how Yelp was not a good source. I started looking at the wedding dresses to find one that would fulfill my credit with the store, Jinny came to me and said JINNY: How are we going to resolve this ME: honestly, if you just give me my money back, you arent losing anything since you didnt even order the dress. JINNY: But we did order the dress, we even took a hit by the manufacturer for $250.00 when we canceled your order but Im being generous in giving you the full $619.00 as store credit. ME: You ordered the dress? When did you order the dress? JINNY I placed the order that night. ME: well thats strange because Marina told me you ordered it around 5:00am or 6:00am from your home. JINNY: no, at the end of the day I always place all the orders via e-mail to the manufacturer. ME: well, if you actually ordered the dress via e-mail, show me the e-mail of the order. JINNY: Im not going to do that. ME: Jinny, you say you ordered the dress, if you did then prove it to me by showing me the e-mail. JINNY: Im not going to show you my vendors e-mail. ME: Is that because you actually didnt order the dress?. JINNY: No, I ordered the dress, Im just not going to show you the e-mail. ME: Jinny, come on, you didnt order the dress. At which time she walked away. I continued looking around at the dresses, Jinny approached again. JINNY: How are we going to resolve this. ME: Jinny, come on, your didnt order the dress. And if I do order a dress to sell I first want to see all my paperwork and would like a copy of all my paperwork. JINNY: I dont have it. ME: What do you mean you dont have it??? JINNY: I dont have your paperwork. ME: Did you lose it? JINNY: No, I just dont have it and dont have time to look for it. ME: Come on Jinny, first you refuse to show me the e-mail of the order and now you dont have my paperwork? JINNY: heres what I can do, I can refund you the deposit minus the $250.00 that went to the manufacturer She then walked away.I told Jinny I decided to take the deposit minus the $250.00 but would definitely be filing a claim with the BBB to try and get the rest of my money. Jinny handed me a check in the exact amount of $369.44 which tells me that she actually DID have my paperwork accessible knowing what the exact deposit amount was I am hopeing to get the rest of my money back, $250.00. I understand that I signed the receipt that stated NO REFUNDS NO EXCEPTIONS but there has to be some leeway for immediately canceling an order before the order is actually placed and dont you think they should have pointed out and/or told me about the NO REFUNDS NO EXCEPTIONS policy. If this was pointed out to me I wouldnt have risked placing the order being so unsure about the dress. And clearly, Jinny basically admitted to not placing the order and is now saying they did. Youd think if they did place the order she would have been happy to prove it to me by showing the e-mailed order AND showing proof that they paid the manufacturer $250.00 for canceling the order. And why would they give me a STORE CREDIT for the full $619.44 if it cost them $250.00 to cancel the order. Then theres the conflicting story of when Jinny actually placed the order
