Subject: Tuffy Refund On 4/17/2010 I was sold a Coupon booklet by one of your representatives, I.D. # 308, who claimed that my nearest Tuffy Auto Service Center, at 137th & Millard Ave. in Omaha, Nebraska, had the equipment necessary to not only diagnose any problems on my 1998 BMW 740i; but, also to re-program it, i.e., turn on DRL, set auto locks, etc. Since I was currently having a problem with my car that the dealer would charge over $100 just to hook it up and read the codes, I thought that I would save some money by taking advantage of your offer at $40. However when I visited with Pat Sheehy, the manager at the location above, he advised that was not true; and, that they can't help with my car at all, since they don't have the expensive equipment necessary that your sales rep vehemently insisted that they DID in fact have. Pat also stated that I could get a refund if I contacted you; and, if not, to let him know. I am sending this email to request that refund, since that was the only motivation I had for purchasing this promotion. For one thing my car takes 7.9 quarts of SYNTHETIC oil (which would negate the included FREE oil & filter changes) and I perform all of my own maintenance otherwise. All of this information was provided to your sales rep prior to my purchase; however, he insisted that they would be able to help me with my current problem. I have now just read on your coupon booklet that no refunds will be made; however, I wonder what the Nebraska Attorney General's office will think about your representatives lying about the availability of services that are not in fact offered when trying to make a sale? Misrepresentation? Fraud? Please close this matter now by refunding the amount that I paid to you in the form of a check on 4/17/2010: $40. <my name>

As you may have noticed, every email that I sent to them contained copies of all previous emails, including the first one where I included my complete name and home address. On 9/1/2010 I emailed the following, with all previous emails and their ONE response attached: From: [myemailaddress.com]

Subject: FW: Tuffy Refund

Here is my contact information, copied and pasted from my first email sent
May 22nd: <my name>
<my address>
Omaha, NE 681xx Plus, you have my email address to communicate, which you have FINALLY done.
What more do you need to send me a check to refund my money? Here's yet another copy of my
original email to you on May 22nd. If I don't hear back from you by
September 15, 2010, I will contact both the Kansas and Nebraska Attorneys General regarding your
fraudulent business practices. I will also post my story online on sites such
as ripoffreport.com and any others I can find to warn people about your failure
to represent yourself in a professional manner. <Attached original email message. See top of this post>
And yet here it is, November 27th, 2010, and I have not heard from them at all. Still waiting for my refund, but doubtful that I will ever see that money again. Fortunately, it was only $40... but still, I don't want others to do business with this outfit and lose their hard earned dollars like I did!

Hi, I'm sorry to hear you had troubles, this is the first time I'm hearing about your problem. If you send your un-used card and your copy of receipt / proof of payment to our office "IN CARE OF HEATHER @ KC PROMOTIONS 401 S Clairborne Rd Olathe KS 66062 suite 203" with a printed copy of emails including time stamps and dates plus any other proof of attempted communication you may have. I will be more then happy to review your information and process a service package for a different shop that can handle a BMW if your still driving that vehicle or a refund if all the information checks out.

I do not know who you spoke to, I am not aware of any Pat Sheehy how did you contact that person? Was he/ she someone from the shop itself or a rep of KC Promotions? I need every bit of information you have including ID numbers for each rep of KC PROMOTIONS you claim you dealt with so I can handle this in the fastest and most proper way and contact our reps for their responses to these accusations as well.

If your coupon has been used then you did get your money's worth out of the card, esp with a more then twenty dollar discount on the full cost of our service package. However with the return of the card and the information I requested I can process it and see what kind of compensation you may be entitled to.

Thank you,
Heather McGowan ID #664
