Ladies Premiere Fitness altered documents, changed personal information,
28th of Oct, 2011 by User834876
I signed a membership with Ladies Premiere Fitness back in 2000 or 2001. I was sold by a high pressure , fast talking sales person with promises of unlimited access, fabulous classes, and expert trainers. Needless to say, they only delivered about halfway on only half of their promises. I regreted my decision but I used my membership for awhile and stopped going but I still continued to pay. Several months after the tragedy of 9/11, I lost my job and had to move. I recieved something by mail after they had tried to take payment out of my account and could not collect. I called them and explained the situation. I was informed that I could put my account on hold for 3 months, but there were no other options. I was told that moving was not a reason to be let out my contract unless I was over 90 miles away from any Premiere Fitness location. It just so happened that I was 90 miles away. First they tried to say that there was a gym 60 some odd miles away. I told them I knew that there was not and that I , by their own admission, should be let out of my contract. One person said I would need to send proof that I had moved. Someone else said I did not have to send them proof since they had already sent something to me at the new address. After several long, frustrating conversations, I thought it was all taken care of . Several years later, around 2003 or 2004, I was contacted by a collection agengy about this membership. By this time I had moved back to the Dayton area. They somehow had got my phone number and address and started harassing me by phone and mail. I explained to them many times how I had lost my job and had to move and how I was more than 90 miles from any gym and was let out of my contract. Unfortunatly, I had never recieved anything from them proving this, nor did I even think to call and ask for something in writing. I figured that was why this had come up again after several years and again thought after speaking with several people on many different occassions that this had finally been resolved. Fast forward to 2011. I receive a letter from my employer stating that my wages were being garnished beginning with my next paycheck! Though I live in Greene county, the judgement came from Jackson county, where I had lived in 2002 after I lost my job. A motion was filed in 2008 and there was a hearing in 2011. I called the Jackson County Courts demanding to know how this could happen without me having any idea. I was told that papers were sent to an old address in Greene County in 2007. I was told it was a done deal and there was nothing I could do about it. I contacted a lawyer and was advised that my only option was to file bankruptcy. I decided to do some research on my own and found out that there is a statue of limitations of 6 years on this kind of debt. I called Premiere and asked for a copy of my original contract so I could get the exact date that I had joined. First she had a hard time even finding me in the computer. When she finally did, she said, "Hmm. . . this is strange. We scan all contracts into our computers but for some reason yours is not in here." She then referred me to the parent company who said the exact same thing. The only thing they could tell me was that my contract was from 2003 to 2006 and it showed "cancelled" in their records. That information is absolutly incorrect. I signed that contract 2 years earlier then they are showing! In my opinion, my contract with the correct dates has been deleted and the dates that they show in their computers have been changed. Now , by their records, it looks like they just made it before the statue of limitation ran out.Something is very very wrong here. I am devastated! I live paycheck to almost paycheck. I can barely pay my bills and put food on the table! I do not have any "disposable income", let alone 25% of my paycheck for a gym membership. I can not understand how someone can just come in and take my money legally, without my knowledge or consent. It is literally ruining me. It has now been 2 checks that they have affected. My last check was barely enough to pay my rent. I have$0.00 to buy gas to go to work or even food to eat for the next two weeks. I am furious that they have used deceitful practices to get me to sign and now again to get money that I DO NOT owe them. I cannot believe my life is literally being ruined over and $800.00 gym membership, which is now $3000. These people need to be held accountable. They expect us to play by the rules and follow the terms of the contract or pay the consequences. Then they break laws and even ruin lives just to get a few more bucks and never have to pay the consequences! BE WARNED!!! Ladies Premiere Fitness is a deceitful, dirty, shameless company! They are the biggest scam ever!
