lanier marine liquidators Kings of ripping of people and shattering dream, they are inventors of the excuses. Dawsonville, Georgia

October 2010 I was browsing the internet looking for a sailboat and found one at Lanier marine.
I sent them an email and paid the boat by wire. 10,900 USD. I booked a flight to check out the boat. Being there we discussed the transport issue. My first idea was to ship the boat to Thailand. But when I was in Thailand I found out they did not have a lot of marinas and registering the boat there would cost too much. I left LML with the papers of the boat, and the invoice. I was then looking to register the boat in Europe, but because the boat had no CE certification I did not have a lot of choices and decided for Montenegro. The cheapest way to ship the boat would have been on a trailer. LML proposed a trailer to be modified price was 3,650 USD. I paid this by wire. My shipping agent was insisting on having pictures and dimensions of the rig. Then came another surprise, to move the boat from J. Shane Vaughan 's dock to the marina and de-masting and putting the boat on the trailer another 2,000 USD was charged. I was insisting on sending me the pictures and dimensions of the unit, but never received any. I received a lot of lame excuses why they did not have the pictures available. Then out of the bleu I received a notice that the boat was too heavy for the trailer and the deal did not go thru. I asked them to refund the money I wired them but they did not want to do this, they said they had a lot of expenses that I had to pay for. I am asking for a refund of 15,000 USD. It should be 12,500 EUR. Here is the last info I received from LML. Shane,I did not hear from you in two months, what is the status?Regards,
J.;

Shane,I will work with you, and I am prepared to drop the charges as soon I see you are doing what you should have done long before: just refund me the full amount I paid for this mishap. If not I will ask to be refunded for my trip to inspect the boat and the bank charges and the losses on the currency exchange also. I could also consider interest for the money you had all this time.So do not try to pull it.I have had enough patience with you and your games.

First, do you want to use a mediator to settle our dispute? If so choose one. Secondly, I feel strongly that it was out of my control that the boat was too heavy for the trailer that was in your budget. I paid the transporter and he will not offer a refund thus some money has been lost because the boat is overweight. I have hired legal counsel to retrieve the money you requested to have distributed to Josh for delivery from my dock to port. If it were surveyed it would have been hauled out and we would have known that it was overweight. Generally the buyer pays for a survey. It is not my fault. JOSH'S WAS PAID TO MAKE THE TRAILER SUITABLE FOR THE VESSEL AND TRANSPORT THE THE BOAT TO THE PORT. JOSH CLAIMS THAT HE WAS MISLED BY INFORMATION AS TO THE BOATS WEIGHT AS WERE WE ALL. HE WAS THE TRANSPORTER AND AGREED TO MOVE SAID BOAT FROM POINT A TO POINT B FOR SAID AMOUNT. IN HIND SIGHT IT SHOULD HAVE BEEN SURVEYED TO KNOW HER WEIGHT PRIOR TO SHIPPING WHICH IS NOT MY FAULT. GENERALLY BUYERS GET SURVEYS. YOU HAVE TAKEN NO RESPONSABILITY FOR YOUR BOAT THAT YOU PURCHSED AS IS. I HAVE TAKEN CARE OF YOUR VESSEL AS IF IT WERE MY OWN BUT YOU OWN IT. I DID NOT WAH MY HANDS OF IT ONCE OFF MY DOCK. THE FUNDS YOU HAVE GIVEN ME WERE DISPERSED AS YOU REQUESTED TO THE APPROPRIATE PARTIES. WHO'S FAULT IS IT THAT THE BOAT WEIGHS MORE THAN THE PUBLISHED WEIGHT? IS IT JOSH"S FAULT? MY FAULT? YOUR FAULT? NO FAULT MIGHT BE THE CORRECT ANSWER. THERE IS NO FAULT ON ANYONE"S PART THAT IT WEIGHS MORE THAN ANTICIPATED. AT THE TIME YOU OWNED THE BOAT THUS YOU OWNED THE PROBLEM. I TOOK THE PROBLEM AS MY OWN AND HAVE TRIED MY VERY BEST TO RESOLVE IT FOR YOU. YOU STILL OWN THE BOAT BECAUSE YOU HAVE THE TITLE. I HAVE BUYERS THAT WILL PAY $12500 BUT I HAVE NO TITLE. PLEASE CHOOSE AN ESCROW SERVICE SO THAT THIS CAN BE RESOLVED. Each party claims not to be responsible. Each party has a pretty good argument. I have taken the most action to resolve the dilemma. As a matter of fact I am the only one to take any action to resolve the dilemma. I am terribly sorry that for the first time Josh did not follow through with the delivery as he had always done in the past. I did fight to get the trailer back from Josh which took about a week. I do still have your trailer. Again now I have a boat buyer again at $12500 and the trailer left to sell. Again we can get you the $15000.00 that you requested after I sell the trailer I can get you $2500 more totaling $15000. Work with me and not against me so I can resolve this for you. I have offered to refund your money upon the sale of the boat that you have the title for but I will not get another party involved in this unless I have the documentation for the vessel back and an e mail from you of release. The fact that you have the title complicates the refund process dramatically. I have had buyers but you have rejected the offers. The buyer is ready to pay $10000 today and the balance of $2500 upon the title. I may be able to refund $2500 more soon for a total of $12500 because of the trailer being sold also. The trailer I can sell because the documents are with us. In a day or so if you have selected an escrow service I will initiate the refund of $12500.00 and follow soon with $2500. Do you want to use an escrow service to get this resolved? Which service do you choose? J. Jan, I am terribly sorry the the boat weighs over 15000 lbs. Thus the transporter would not deliver the boat although he was paid to do so on your behalf. I have paid a marine surveyor Ottie Stringer $300 to examine the boat to discover why the boat weighs over the NADA weight posted. It contained no water. The rudder is saturated but not the hull. It is known that the heavier they are the better they sail. It must be that it was ordered extra heavy from Hunter. I cannot refund the $15000 because I do not have it. I paid the transporter Josh $2100. He will not refund any. I have paid my attorney Frank $500 to try and get money from him and he is working towards that. I paid the marina $500 to launch and re mast the boat and for storage while out and on the hard. I paid Tom Buchanon $350 to move it back to my dock from the marina. The boat has been stored at my dock for all but the 60 days it was at the marina. The value of the free storage would be $300 per month for 6 months. $1800. No charge for my dock storage but it is a major inconvenience. I have paid Jerald's Marine $250 to assure me that the boat was not taking on water once at my dock and for the installation of a new battery. I have paid John my mechanic and both Vince and Roman our sales personal and our upholstery guy Arron salary wages to show the boat and give estimates for new upholstery. I have paid to Allan clean the boat so it will show better and be more likely to sell. I have had offers of $12500 which you have rejected. I have no title which clearly means she belongs to you. I cannot sell it without the title. I am clearly brokering the boat on your behalf. A survey to learn the accurate weight in the onset would have been a good idea to determine the shipping and if I would have had any idea that it was needed I would have demanded that it be done. I have never heard of a boat weighing so much more than the listed weight that it could not be delivered as planned by weight posted on the NADA. Another trailer would have been a solution but none was available at that low price. It was your boat and is your boat and it was your trailer and is your trailer. The trailer has been stored here for 6 months and is so large it is a major inconvenience. Trailer storage for 6 months at $40 should apply $240. I have done all that I can do and frankly all that I can afford to do in both time and money. I have spent about a week of my life on this deal and will have made nothing if I refund $10000. I have never had such a screwed up deal. I can only afford to refund $10000 today if that will work. Please let me know if that will satisfy you. I do want to satisfy you and have tried and tried to do so. I will need the title. There are escrow companies that we can use to assist us in the transaction. I send the funds to them. You send the title to them. They forward each to each of us upon having both to forward. J. Shane,Again we reached the and of the month and you did nit even send me a message.My patience is reaching the end. I have started a new project and need money for this. I count on the money from the boat to do this, so please do something.
best regards,
Jan Shane,the minimum price for the boat should be 13,000 USD. For the remaining 5,650 would say we keep it at this price.

The 12500 euro would be around 18163.7469 USD, so you are still some way of. The problem is that you charged me 2000 USD for preparing the boat to ship it and another 3650 USD for the trailer.And as the US economy is not doing well the dollar drops steadily towards the Euro;Originally the rate was at 1.3632 USD/EUR on 22 Nov. 2010. Now we are at 1.4538 USD/EUR.The longer you wait the more you will have to pay, because of the politics and financial problems the US are in.So you hope is in vain.
