My complaint with Ken Gunter started with someone he knew/employed calling me about my truck in the Thrifty Nickel. I met with him at his lot “Texas Trucks” on Franklin Drive in Waco, Texas. After hearing his proposal, I told him I would need to bring the truck back later as the taillights did not work correctly and the State Inspection was expired. He told me he would take care of both of these. He also informed me that my insurance should handle any damage to my vehicle if something were to happen, but not to worry because he had excellent security. I then signed an agreement with him and paid him $340.00 to advertize my truck, with a stipulation (on his own form) that if the truck did not sell in 21-36 days I would get half of that back. (4 June 2010) In the following months, I checked on the truck 3 times on the weekend…drove through the lot, and got out and walked around the truck, and never saw anyone…Excellent Security? Then I didn’t check on it for a while because I was in no particular hurry to sell in a down market. Next time I went to check on the truck it was gone, two days later it is still gone, so I called Ken and he tells me he has started another location and my truck is over there. He calls me later to tell me he has actually started another business and I need to come sign a new agreement where he will show the truck but customers will call me with questions or to find out specifics. I could have done that myself in the Thrifty Nickel. About the middle of October I go to look at the truck on his unfenced lot on the Interstate …still no offers… and find that someone has stolen the LED lights and wiring out of it. When I go in to talk to Ken about that he tells me they were stolen at the other location, and he never even bothered to call me and tell me. We argue back and forth and he finally tells me he will replace the lights when the truck sells…I say you mean if it sells…he says “Oh no, I am going to sell it”! Shortly after that, around the first of December, he calls me and tells me he has someone who wants to buy the truck from Oklahoma, I get on the Web to look at the ad and find the sentence “This engine has been completely gone through.” To me this implies the engine has been overhauled and I never told him such a thing. I told him the engine had 161,000+ miles but still ran great and neither leaked or used oil. I went to get the truck as I told him I could not sell it through him now, as that statement made me liable for something I COULD NOT DELIVER. At first he denied the ad saying that, so I told him go look at it, “I just looked at it a half hour ago”. When he saw it he said “…well I wonder how that got on there. “ DUH… it is his website. At this point he refused to replace the taillights, but told me we could file a police report so my insurance would cover them. I said you’re going to file a police report about a theft that occurred months ago “at your old location”? He said sure! I told him he just owed me about $300.00 for the lights and wiring plus the $170.00 from our original deal, and he told me he was not going to pay me anything, as a matter of fact I owed him for extra advertising, which I never asked for or agreed to. (We never made that second agreement.) I then took the truck home and said the only way I would sell it through him was if he brought me cash in hand for my share and then the truck would be his and he could do what he wanted with it. He actually advertised it for several more weeks and had the guy from Oklahoma call me for details (I was nice but honest in describing the truck and did not say a thing about Ken), but nothing ever came of it. I have not spoken to Ken since. Ken’s Response via email: Hi Gerry, I don't know what is going on, and why you are upset, could you please call me ate your convince on my cell number 254.XXX-XXXX Thanks KG My Response to Ken: Nope, had your chance and you did not want to talk when I picked up my truck. All I need from you within one week is payment for what would be right: $200.00 for stolen LED lights $70.00 for wiring harness and labor $170.00 for refund on original agreement As you can see from the attachments, unlike some people on the web, I will not be saying anything libelous or inflammatory; I will not even be posting my opinion...just the facts. I believe they will speak for themselves. If this fails, then I will proceed to small claims court. You decide our next course of action. Ken’s response: I handed you the keys or can you remember that? Your truck should have been picked up months ago, but we let go with the intention of you selling it, we clearly state that we are not responsible and I told you that. Quite felling sorry for yourself and grow up... IN OUR CONTRACT WE STATE THAT WA ARE NOT RESPONSIBLE... THAT MEANS ANYTHING ON YOUR TRUCK, THAT'S WHY YOU HAVE INSURANCE... SO DO WHAT YOU NEED TO DO, AND AS FAR AS RIPOFF.COM I WILL LET EVERYONE KNOW THAT YOU ARE A DISGRUNTLED MAN AND WOMAN THAT CAN'T SELL A 160,000 MILE TRUCK WE got tired of jump starting everyday. SHOWED IT OVER AND OVER. NO WE DID NOT SELL IT. AND JUST LIKE YOU, YOU TRIED TO SELL IT FOR MONTHS, SORRY BUT I WILL WRITE BACK AND DEFEND US. YOU ARE NOT MAN ENOUGH TO JUST FIX IT AND GO ON, BUT I HAVE RIGHT AND I WILL USE THEM. I'm really sorry that it has been tuff for you to sell the truck, I had many offers for 4-5k but you wanted more. Well I will not be imbarrassed or upset. I will be there everyday, and I just did not have time to set and listen to you grip about your lights, and jump your truck for you.

Mr. Nance it is plain and simple as the contract stated we are not responsible for any damages or theft associated with consignment. You signed a contract knowing this. It is not my fault they were taken and I could of helped get some for you at cost. Our new lot has a gated fence and we have much more protection then at the Franklin location.

Pretty slick Nadine...why didn't you post your reply to this complaint where the complaint was originally posted which was "Pissed Consumer". Did you think if you copied and pasted it here and then replied to it no one would ever know about the original?
As to your reply, the first sentence I understand...IF… the damage occurred at your first lot where we had an agreement, but since no police report was filed and I was never notified, how am I to know when/where it happened? Ken advertised the truck at the I-35 location with the LED lights in the photos...we had no agreement whatsoever at that location as the truck was moved to the new location/business without my knowledge. Was that false advertising?
That contract I signed...Ken owes me half of the payment as a refund because the truck did not sell in the allotted time, which HE stated!
You could get me some lights at cost? Ken refused to help with them at all...plus why would I replace them at cost when, as I have said, it seems when they disappeared it was at a location where I had no agreement.
As to the last...kinda like closing the gate after the cows are out...remind me again how long was my truck sitting there before the fence was built? Right beside a busy Interstate...maybe that is when the lights were taken?
