Ocwen Something wierd is going on...who is 1st National? Orlando, Florida

My husband and I filed Chapter 7, including our house. We are tired of dealing with Ocwen, and the economy has trashed his paychecks. So, we figured with all the hassles they have given us, it will do them good to have our house sit on this trashed housing market in Ohio, and slowly deteriorate. Our lawyer told us a few interesting facts. The main one being, if a Sheriff shows up at your door, and doesn't have proof the house has been transferred into their name, you have a right to tell him to leave. If the house has not been transferred into their name by the time the sale comes up, they can't sell it.Somethings no one ever tells us.

Anyway, we got the motion for relief from stay papers a few weeks back, thru our lawyer. When I read them, I noticed the name was First National Bank Association. I have never heard of them, nor seen their name anywhere on any paperwork associated with our house. I figured they were part of the conglomeration. Thank God we have awesome attorneys and an awesome bankruptcy court judge. She put a hold on the motion, and gave them 21 days to prove they have the right to take our house. I just got another paper from the bankruptcy court today, that says they never provided that proof, so our foreclosure is cancelled.

I don't know what's going to happen now, but if you get foreclosure papers, look at the name. If it's something different, get a lawyer involved.
