In December of 2010, I discovered Payday Loan had withdrawn $30.00 from my checking account, without my permission or knowledge and filed a complaint here, with the Utah and Nevada state government internet fraud sites and subsequently had my bank block PDL from being able to withdraw additional monies in the future.
Everything was fine until yesterday (March 17 2011) when I received a call from an attorney in Miami Florida, threatening me with a lawsuit unless I repaid the $250.00 loan I had taken from Payday. I argued that I had never taken such a loan and in fact, Payday had illegally withdrawn money from my account in the first place. I explained to the attorney that with this information, my take now on this is Payday was upset because I blocked them, and they can no longer steal my money and get away with it, and would stoop this low to connive innocent people with threats of lawsuit and hope they just pay to avoid paying for an attorney. I argued profusely with this attorney and even questioned his legal stance on this, all but calling him a fraud too. I asked for his name, address, phone number which he did provide and also researched it online to ensure he wasn't a fraud (he isn't), but told him that under no circumstances would I provide to him a faxed copy of my bank statements over the past 5 months. He said he needed to this to prove I was being honest regarding Payday's claim they had deposited $250.00 into my account in October of 2010. We settled this dispute to a certain level with his agreeing to send me through postal mail, the complaint filed by Payday that states I borrowed money through them and on the internet and once I was satsifed this was not another fraud I would consider sending him my bank statements. I am suggesting that everyone that has been victimized by this fraudulent company, file a class action lawsuit against them and have criminal charges brought against them for fraud.
