Pure 24 Fitness Illegal contract and LYING! Eldersburg, Maryland

On Dec. 15th 2009 we joined Pure 24 Fitness (originally daily24fitness). In Feb. 2009 the gym closed for a short period as it was changing owners. In August 2010 we contacted Eric (owner) and told him we wanted to cancel our membership. He told us we had a balance due and couldnt be let out until we paid the balance. We both agreed to a solution: he would forgive past due of approx. 2 months dues if we signed a new 6 month contract. On August 13th 2010 we signed a 6th month contract- that would give us an end date of Feb.
2011. On June 23rd 2011 I went to Pure 24 Fitness and completed and handed in our "membership
cancellation request." I was told we would have 1 more monthly withdrawal taken from our account by eFit in July. Come July, $61 was taken from my account on the 6th instead of the 16th as expected and such my account was overdrawn and my bank charged me a $37 fee. I called Eric about this and he said to email him and he would reimburse me as I was not made aware of this new date change. I emailed Eric that night (July 11th) and never heard back from him. He claimed to have called us but after checking over our phone records we saw no such call. (These records can be viwed if needed). On August 5th I checked my bank account and another $61 was drawn from eFi!! I called Eric on this day and he said there was a issue with my contract so I asked to meet him at the gym to look over what he had on his records. I brought with me my 2 contracts as well as my member cancellation request. Eric said they didn't even have my current 6th month contract on file! He also said that my first contract was a 2 year contract and therefore it negated my current 6 month contract that ended on Feb. 2011. I debated this because why would Pure24fitness create a new contract for me if I was still operating on a previous contract? Even if Eric is correct that the original contract was 2 years and it was the working contract (which I completely disagree with) it states in that contract the following: "I may cancel this agreement upon 30 days notice after my first year." My first year from that date would have been Dec. 15th 2010. All I want is what is fair and right - to be out of this gym as of June 23rd (or July 23rd if you count their 1 month additional fee). He is illegally holding us to this past contract. On Aug. 15th I contacted eFit (the financial institution that collects out dues) and they refused to get involved besides to call Eric and tell him to contact us. Its been 3 days and Eric refuses to return the phone calls and email I sent.

Sounds like this guy Eric is just a scam artist. I would avoid this fitness center until they change managers to someone with integrity.
