Rusty Eck Ford Omaha Rusty Eck False Advertising - Deceptive Sales Practices - BUYER BEWARE! Omaha, Nebraska
6th of Sep, 2011 by User419339
The week of March 28th, 2011, I drove by this dealership multiple times... I kept seeing the BMW 335i Sedan with a $25,000 Price on the windshield. I finally stopped in to take a closer look. I must say, 95%+ of all the cars on the used car lot had huge yellow/orange Prices on the windshields (pretty typical of a dealership) A sales rep came out and introduced himself, asked if I had any questions, commented on how great of a price there was on that car. I asked him, to please verify the price of $25,000 which was printed in large 8" or bigger leters on the windshield, I was a little concerned because I thought a 2009 BMW 335i would be a little more, plus, there was some smaller handwriting below the neon price saying "Only 25,000 Miles) (I have Pictures to show the advertised price) The sales rep went inside the dealership while I looked at the car. He came back out within about 10 minutes and said "Yup" that's the price, it's $25,000! I then said to him, "Well, I might be back this week, maybe we can make a deal ... it all depends on how much you'll give me for my trade in" (I was skeptical that they would give me enough to pay it off, while still keeping the BMW price reasonable) Saturday April 2nd, 2011, I went back to Rusty Eck. Brought my trade-in with me, all nice and clean. I test drove the BMW, while Rusty Eck evaluated my trade. During this time, I picked up a friend, and brought him back to the dealership with me. I got back to the dealership, met the same sales rep, we sat down at a table. The sales rep let me know that this was his first transaction, that another experienced sales rep was going to come in to talk about the cars. The new guy shows up, we start talking about the deal... He starts jotting stuff down on paper .... $25,000 for the BMW $9,500 for the trade in, leaving a difference of $7,000 in payoff, new net price of : $32,000 for the BMW. I immediately told him that they really had to give more for the trade in. The car was in great shape, had fairly low miles, and I already knew that KBB wholesale was at $13k. I told him that I would be willing to absorb some of the difference in payoff on my car, but not all $7k. I suggested that at $3,000 or so, I'd be happy and would sign a deal. Making the BMW now $28K. The closing sales guy got up, and went to the "Deal Desk". As he did that, my friend and I noticed that people started gathering around the BMW outside the windows. I leaned over to my friend and said "Watch this, they made a mistake on the price" Sure enough, the closer walks back with a solem look on his face .....He says "Wow, there's a big mistake" I responded with "What?, wrong price on the BMW?" He said yes, "Detail, somehow listed it wrong, it's really $29,xxx." I said "Wow, that's a pretty big mistake ... that's why I came in several days ago to confirm the price with you guys" Sales rep number one went and verified, came back outside and affirmed the price of $25,000 on the BMW. The closer says "we'll do you right, this is our mistake after all". I told him that I was certainly not interested in paying the now "New" price of $29,xxx, plus adding in $3k in payoff difference .... He left the table, my friend and I talked a little more about how strange this all was ..... it seemed they were trying to pull a fast one ... The closer came back and said "Ok ... what if, I sell you the BMW for $29,xxx, we payoff your trade in? Would you take that deal?" I responded "So, I pay your new price of $29,xxx on the BMW, but now, Rusty Eck takes care of my payoff on the trade in, so in essence, I'm getting a very similar deal to before, when the car was $25,000, and I was willing to add $3k in difference of payoff to it......" the closer said yes, it was our mistake ...... I'm really sorry for the confusion .... I was excited. I wanted the car, I liked the car, and now, I was pretty much getting the deal I went in for. It was great! I had now spent several hours at the dealership, I had to pick up my kid, drop off my friend before hand, it was Saturday afterall ..... I was in a hurry. I was in such a hurry, that I went through the paperwork/closing office with the finance guy in about 10 minutes.... I signed off on everything ..... Fast Forward ... a month later, my own bank is telling me they can give me a better rate for the car I just bought ... so I called the other bank that the loan went through and asked for my payoff ..... To my astonishment, she says .... your payoff is $36,xxx.... I said "Excuse me?" "Did you say $36,xxx?" she replied with "Yes Sir". I immediately went out to the car and grabbed my paperwork...... OMG! You have to be kidding me! Rusty Eck not only changed the price of the car from $25,000 to $29,xxx, but they also added in the full $7,000 in difference in payoff from my trade to the new car amount ... making it a $36,000 BMW! I didn't even see it. I didn't even catch it. I would never have signed that deal knowing what was really going on. I had a verbal commitment from the closing sales rep, I had the deal I wanted ... I didn't even think about it, I was so rushed and excited at the same time. I called the general sales manager, we finally connected. He basically told me "Sir, I see the price for the car was $29,xxx, and you signed all the paperwork" I told him the whole story. He said, "Well, that wasn't the price of the BMW, it was showing the mileage on the car" I said, "well, I actually had your sales rep go inside and verify the price, before I came in on Saturday, On top of it, your closing sales rep started dealing with me on a $25,000 price for the car as well" "Obviously, everyone thought the car was $25,000" I asked the GSM, "So, are you saying that the other 100+ cars on your used car lot, with the same big neon lettering for prices, is actually listing Mileage??????" Why would you advertise a 2 year old car having 25,000 miles in big orange/yellow numbers..... that's not impressive, that's not a "low mileage selling point" I told him that if I didn't have some sort of resolution, I would seek other avenues ... he basically told me to "Go Ahead, and do what you need to do". Within about 10 days, all the used cars on the same lot had all of their big orange/yellow prices removed from their windshields ... hmmmmmm I wonder why??? Before they removed them, I took many pictures of all the cars on the lot, just to show how they obviously advertised the pricing on the windshield .... I also have pictures of the car I ultimately got tricked into buying as well ..... I have since had correspondence with the General Manager - Vince Armijo, but, he became non-responsive. My Points ... They obviously advertised a price of $25,000 on the car. They in turn, took that back, telling me it was a mistake, but yet, they found a way to still essentially give me the same deal, because it was their way of "Doing right by the customer" I got snowballed, schooled ... whatever you want to call it... In the end, not only did they end up getting an extra $4k+ on the price of the car, but they ended up making me eat the whole payoff difference on my trade in, whic I had already disagreed on earlier in the transaction while the BMW was still only $25,000. I basically got ripped off over $7,000, and no one can do anything about it. On top of it all, I had to replace the clutch and flywheel within 4 weeks of buying the car .... $3,000!!!!! False Advertising ... Deceptive Sales Practices ... Buyer Beware ... I'd suggest going to another Ford dealership if you really need to buy one ....
