The Rush Fitness Complex Fraudulent Contract Length Winston Salem, North Carolina

My husband and I signed up for memberships at the Rush a little more than 2 years before our wedding date with hopes (especially for me) to get in shape and be healthy by the time my wedding came around. I wanted to look fabulous in my wedding dress!


We signed a 2 year contract with the Rush in the Fall of 2008, knowing that this contract would allow us the use of a fitness complex until our wedding. We had to paid a ridiculous joining fee might I add. At the time, we thought we would be moving shortly after getting married, so we were sure to thoroughly discuss our contract and agreed to a length that would only be valid for our guaranteed stay in this city, 2 years.


Approximately 2 years passed, and shortly before our wedding, I called the customer service department to find out when our drafts would stop being pulled from our accounts - no telling how many tries it took before I finally got through. Every time you call their department you get this recording "our cue is currently closed. We will reopen tomorrow at 8 am." This is not necessarily the case. I called several occasions and heard this recording even during the middle of the day! If you're actually lucky enough to get through, you're usually on hold for at least 15 minutes before someone finally takes your call.


When I finally spoke with someone in the corporate setting, they told me that our contract was for 3 years! I was furious. There was no way that my husband and I would have signed a contract binding us after we thought we would be moving to another city. I called the local Rush and while they were extremely nice, they did not have any information on file, and told me I would again have to contact Customer Service.


Customer service sent me a "copy of our signed contract" and indeed it said 3 years in the box that we were 100% sure originally said 2. They refused to let us cancel and informed us that we were bound to pay the remaining fees for the coming year. We canceled the debit cards from which our automatic drafts were coming and decided that we were entirely certain that we did not sign up for a years worth of fitness memberships that we would never use. Today we received collections notices in the mail for a years worth of membership fees!


Although we are not entirely certain of how and when this mis-communication occurred, we are still very curious as to how our 2 year contract suddenly grew into 3? Not entirely ethical or honest in our opinions.
