On March 9, 2011 I contacted Mr. Billy White (or
William White) regarding installing a new HVAC heat pump which was heavily advertised on craigslist.com.... We reached an agreement that he would put in a used 4 ton Trane compressor for a total of $600 ($400 for the compressor and
$200 for labor). $400 of the total paid would be credited back to us to put towards a new unit once we could afford it. We agreed to meet on 3/10/11 at the Super Wal-Mart on Rt 17 in Stafford, VA around 10:30.. we met, I received a paper
stating what was going to be done, the cost, that he received a deposit of $400 and the balance was due upon the completion of the job. He stated that he would call Monday morning, 3/14/11 to set up a time to come by and install the compressor.
He didn't call so I called him.. He stated that his son was sick all weekend and he was on his way to the Doctors, he would call me back that night. On 3/15/11, I hadn't received a call back from Mr.
White so I called again and left a message expressing my concern for his son but he really needed to contact me to get the compressor installed. On 3/16/11, I called and left 2 messages (because I had not heard back from him since Monday) stating that he really needs to get in touch with me to either get the compressor installed or I want a refund of my money. After leaving the 2 messages, I printed a copy of my cashed check that was supposed to be deposited vs cashed because I wasn't sure if my husbands pay check was direct deposited or not. I contacted my bank,
BB&T, to verify which branch the check was cashed at and if they could give me any info (address) so I can try and track this person down. They said due to privacy issues, I'd have to contact the local police to get a subpoena to
the bank for then to release the information. I have his craigslist.com ad, the paper he gave me, in person that states what was to be done, that he received the deposit and I have a copy of the cashed check. I also still have a locked up Heat pump compressor to prove the work was never completed. Since the phone number he gave me was a cell #, you can track each call I made either via home or my cell number to reach this person on a daily basis and it will also show that there were no returned calls to either of my numbers. The gentleman has scheduled an appt for 3/17/11 to install the unit.... On or about March 24th, this is the contact my husband had with him:
After repeated attempts from my wife to contact Mr. William White regarding installation of our Trane heat pump compressor and no return phone calls, I contacted Mr. White pretending to be another customer. I asked
Mr. White various questions regarding availability to come over to a location.
He was eager to answer questions and stated that he could be over in 15 minutes. I asked him if had had the necessary parts and he stated that he did. I gave Mr. White all opportunities to exempt himself from this work and gave him the exact compressor that he was supposed to install at our home. After all attempts for Mr. White to back out of the work, I identified myself and who I was. An argument ensued and I ended the conversation. On April 2nd, 2011, he called and said that he would be out the following week to complete the job. As of 4/14/2011, Mr. White has installed a non working compressor and stated that for an additional $225 he would install a Carrier heat pump and be done. He said that it was only $25 more than the original quoted price of $600 for a
completely different unit installed and he would wave the additional installation costs. I didnt tell my
husband about the addition funds being paid to him because it was the same about (+$25) that we would have owed him HAD he complete the job the first time. At the time, I thought it was a good move but I know better now. As of today, April 14, 2011, he has not returned my daily phone calls to schedule a date to complete the job. As of this morning, I called and his cell phone had a message stating the person you are trying to call is not accepting any calls at this time It has been over a month that I have not had a heat pump in working order and he has $625 of my money I have left several messages on his cell phone. He finally returned my call stating that his wife took his other phone and to use 540-840-7494 as his new contact number. He mentioned that he had the unit and would install in on Monday April 18th and would call on Sunday, the 17th, to confirm his arrival time. On April 18, I called Mr. White to confirm his arrival time but had to leave yet another message. Mr. White did return my call but I wasnt home. He stated that it was spring break for Spotsylvania County and he had his son all week but would be here on the 25th. That he would call me later during the week to set up an arrival time for the 25th. On April 25th, he didnt show so I called him but again had to leave another message.
He returned my call but I wasnt home.
It was spring break for Stafford County so he left a message at 10 AM on my phone ( I still have it saved for evidence in case I take him to court) stating that he was going to give his buddy a call in a few minutes to get his help on
picking up a complete Heat pump. If that didn't work, he was going to see where his father parked his truck so he could borrow it to haul the unit to my house.
As a last resort, he would rent a truck and have the unit installed on Wednesday morning at the latest. After 2 messages left for him on Wednesday, still no show and not returned call. I have asked for all of my money back $625.00 so I can hire someone else to fix my unit but there has been no response on that either. On April 28th, I called and left him a message that I was going to be at Chuck E Cheese at 11:30 AM for him to meet me
there and that he had 2 choices refund my money or we would be taking him to court. We left around 1:30 and he did
not show and no phone calls. On May 2nd, my husband did some research on trying to locate his address in order for us to send him a subpoena. He found an address which physically led him to Mr. Whites wifes house on Chesterwood Drive in Spotsylvania. Donna gave my husband his current address, where he supposedly lives with his parents on Flint Hill Ct in Spotsylvania. He called our house at 9:14 PM that night but I refused to answer the phone hoping he would leave another message I could use in court. There was no message left. On May 6th, I filed a law suit for the amount of $4500.00 + court filing fees.
These fees are to cover the cost of a new unit completely installed and charged with R22 Freon, the fees we paid to Mr. White for services we have not received, for suffering. I run small day care facility in my home and on the days it was too hot, my daycare kids were unable to nap due to sweat. My husband and I personally have suffered in many ways including sleepless nights due to heat and humidity, there many arguments between us on how to handle the
situation which put a wedge between us.
I have spent many days waiting for him to show and complete the job he was hired to do which also put a damper on my daily routines with my daycare kids. It is now May 9th and no additional contact has been made by either parties.
I have contacted Verizon (our home phone carrier) for a detailed phone report from March 10th to present to show exact dates of possible contact but they are unable to provide that information without a subpoena from the courts. I have provided copies of our cell phone bills show attempts made from those phones. As of May 18th, we have several estimates and service tickets showing that the compressor was in fact a 3 phase
commercial compressor, the wiring was messed up, the unit itself was left in shambles, etc., and that the unit is not repairable. The estimates for a new R22 4 ton Heat Pump range from $2800 - $4702.
