Garn Restoration Ryan Garn Failed to seal around main sewer pipe exiting house causing groundwater to leak into basement, Internet

Garn Restoration was hired by us after a house fire for smoke/water/fire damage and to rebuild our home. They also hired subcontractors for the plumbing and electrical. Since our home had a tremendous amount of smoke damage, all of the electrical, plumbing, drywall, windows, etc. needed to be removed and replaced. Garn Restoration subcontracted the plumbing work to Plumb Crazy to replace all the plumbing, including the main sewer pipe in our home. This sewer pipe attaches to the main pipe inside the poured concrete wall in our basement that connects to the septic tank. Our basement was a "finished basement" so a drywall wall was built on one side of the pipe and the poured concrete wall was on the other side. This pipe runs approximately 15-20 feet along our basement wall. Less than two years after moving back into our home, we noticed mushrooms growing in the carpet of our basement, in the basement bedroom closet and between the baseboards and carpet. Further inspection revealed mold and mildew along our basement walls. Items in the basement bedroom closet and under the bed had mold growing on them. We began tearing the drywall wall out that was in front of the sewer pipe. We discovered that groundwater had been leaking into our basement around the sewer pipe that exited through the concrete wall. Since the sewer pipe was behind a wall, the leaking water was not noticed until a year and half after we moved back into our home. Further inspection revealed that after Plumb Crazy replaced the pipe, they never sealed around it. Garn Restoration was the general contractor and also failed to seal around the pipe. The county Building Inspector "passed" the inspection and also failed to notice the pipe had not been sealed around it. I was told by my Homeowners Insurance company that since this house was a "new build" from the fire, I needed to contact the original contractor. When I contacted Garn Restoration, they sent someone out the following day. He took pictures and stated he would take the information back to the office and "discuss it." They sent an employee out the following day to seal around the pipe. They also sent another employee out to our home to begin tearing out the affected walls and assess the mold damage. The following day, the same employee came out and stated he was going to clean the carpet. Due to the carpet being stained and mushrooms growing out of it, I refused to allow them to just "clean" the carpet. I insisted on the replacement of the carpet. An hour later, he was finally given the go ahead to tear the carpet out. Due to the amount of damage to our basement and personal items, I contacted Ryan Garn and requested their insurance information. Ryan refused to give me the information, stating that I did not need that information and could not file a claim against his insurance company. He argued with me over the insurance issue for several minutes and still refused to reveal his insurance information. Two hours later, he called me and asked if he could come over and talk. I agreed only if he brought his insurance information. He agreed. When he arrived an hour later, he brought his Operations Manager and two supervisors. After inspecting the pipe and all the damage, Ryan Garn agreed to repair all the damage and finally complete the work that the insurance company paid them to do, that they never completed. (We still have a smoke odor in our basement, the Kilz that they sprayed in the basement was peeling off and the smoke color is more evident. Also, when they painted our garage ceiling, that began peeling off within six months of moving back into our home.) I spoke with Garn's insurance agent several times, however, the insurance adjuster never contacted me. I finally received a phone call from Ryan Garn and he explained to me that their insurance adjuster determined that Garn Restoration was NOT at fault and they would not pay on our claim. Ryan stated that their adjuster determined the plumber, Plumb Crazy, (that Garn Restoration had hired) was at fault and they should file a claim against their insurance company. Ryan Garn stated that they discussed it with Plumb Crazy and the owner stated that Plumb Crazy did NOT replace the pipe, so it was not their fault and they would not file a claim on their insurance either. Therefore, no one is accepting responsibility, so we are on our own to repair the damage from their negligence. I told Ryan Garn that I have proof that either they or Plumb Crazy replaced that pipe, as I have pictures of the wall without the pipe and with the new pipe. Also, Garn Restoration was paid by the insurance company to replace all the plumbing and I know all the plumbing was removed and replaced in the home after the house fire. We now have thousands of dollars worth of damage to our basement and contents and Garn Restoration refuses to repair the damage due from their negligence or compensate us so we may hire a new contractor. In all, three separate professionals failed us. The plumber, Plumb Crazy failed to seal around the pipe; Garn Restoration, who according to the Building Inspector has the ultimate responsiblity of sealing everything for subcontractors; and the the county Building Inspector, who passed all the construction on our home.
