We responded to two ads for horses on Craigslist that were placed by Elizabeth Jones and Lauren Henson of Hickory Hills Equestrian Center. The first ad was titled "Kid Broke Horse" and was advertised as something that would make a great pony club horse. This horse started bucking the very first time we rode him. We also had some girls from pony club ride him that both agreed he was not a kid friendly or beginner type horse. He would also kick out if you tried to pick up his feet. The second horse was described as a cute pony that had been used as a lesson pony and a great hunter jumper prospect. This horse was barely broke to ride and in addition to some bucking, we discovered that this pony was gaited. When we contacted the previous owner, she stated that she had only used the pony as a brood mare for the years she had her, and that she had bought her from a barn in Tennessee that we later learned was known for having gaited horses. After several conversations, Elizabeth Jones of Hickory Hills Equestrian Center, agreed that she would refund our money in the form of a check if we made the 1 1/2 hour drive to bring them back. When I returned the horses, she inspected them, trotted them to make sure they were still sound, then removed their halters and placed them in a holding pen. At that time she informed me that she was not going to write me a check for the refund because my check had not cleared. Even after showing her a copy of the cleared check from my bank that I had printed out in anticipation of such a move, she still refused to refund my money. She stated that she would mail me a check when it had cleared her bank or that I could take the horses back with me and not receive a refund. I said that I would prefer she wire the money directly to me and she agreed that she would do that. I did not want these horses back on our farm because they created a safety issue and we have a lot of kids that ride with pony club that are in and out of our barn. Safety is the most important aspect we look for in our horses, and these two did not meet those requirements. After leaving the horses in her care at Hickory Hills Equestrian Center, she later called me and informed that one of the horses had an eye injury and that she was going to take it to the vet and would not be sending me a refund. She later called and said that she was going to have to treat the eye and would let me know of the results that is the last word I have heard from her. Later that day I sent a request in writing demanding a refund here is the text of the letter: Dear Elizabeth: This is a request for the refund that was promised for the two horses, Sully and Barbie that were purchased from you on April 14, 2011 and subsequently returned on April 19, 2011. Sully and Barbie were not as you described in your ads placed on Craigslist. (I have attached a copy for your reference) In those ads, Sully was described as a kid broke horse that had been there and done that and Would make a great play day, 4-H, or pony club horse. Sully broke into a buck the very first time he was ridden, and we notified you of the problem. He does not meet the requirements of a kid broke horse. Barbie was described as being used previously as a lesson horse and a good potential hunter jumper pony. We had two Pony Club girls ride her and she acted like she didnt know anything and bucked a little as well. Additionally, she would get into a gait when they attempted to ride her. She does meet the requirements of a lesson horse nor is she a candidate for hunter jumpers. We also talked with her previous owner who said in the years she had her, she was just used as a brood mare and at the $500 price they sold her for she was not being sold as a lesson pony. We have multiple witnesses and videos that will attest to the way the horses rode. The girls that rode them both agree that they would not be a suitable mount for a Pony Clubber or beginner. On April 18, 2011 you agreed to take the horses back and refund our money in the form of a check when they were returned. After driving 1 hours and transferring the horses to your possession, after you had inspected them, you informed me that you would not be writing me a check because my check had not cleared your bank. Even after showing you a copy of the cleared check from my bank(I have attached a copy for you), you refused to refund my money. My bank has since said that you or your bank could have called and confirmed that the check had cleared. I was told that my only options were to take the horses back home and no refund would be given, or leave them there and you would wire the money directly to me. After leaving the horses in your care, you later called me and informed me that Sully had an eye that was scratched and swollen. I informed you that his eye was not like that when he was returned. The horses were returned, inspected and received in the same condition we received them in, and I expect to receive a full refund by tomorrow, April 20, 2011. Below is my wiring information:....... To date I have not received a response and will be filing a lawsuit to recover the money. Luckily, this was a very small amount of money that we were taken for and it's more about the principle in our case, but they do promote more expensive horses on their website and I would encourage people to think long and hard before getting involved with these people. They proven to have either unethical intentions or inexperience at best, but either one is dangerous when your dealing with an animal like a horse around kids.
