Maitz Home Services Not honoring 5 year warranty and compared to competition overcharging for part by $324. Allentown, Pennsylvania

On August 29th, 2007, Maitz Home Services made a service call to my home to repair my A/C unit. They told my wife it needed a Universal Motor-mate capacitor and pre-warned her that the Universal Motor-mate capacitor was rather expensive, in the price of $394.00. Knowing that the A/C needed fixing, because she has asthma and allergies. She agreed to have them repair the A/C unit.


On August 19th, 2010, our A/C unit needed service again. I had called Maitz Home Services at about 4:30pm when I got home from work to place a call for service, knowing they offer service calls up to 8:30pm. Their receptionist had said the earliest they could send someone out was Friday, August 20th in the afternoon, though couldn't guarantee that time. But they would call with a more exact time later that Friday. With that response and knowing the temperatures were to be in the high 90's again on Friday, coupled with my wife's asthma and allergies and her being home from work that day. That time schedule wasn't going to be acceptable. So, I had called around to a couple of other A/C repair companies for service. I had found one to be able to give us service in a quicker time schedule. So, I had schedule service with this other company and called Maitz Home Services right back to cancel their service call. The other service company diagnosed the Universal Motor-mate capacitor had failed and replaced it. After seeing that this other company charged a lot less for the Universal Motor-mate capacitor, I decided to do some online research on the capacitor and noticed the capacitor carries a 5 year warranty. I had tried contacting the Motor-run Direct company by email and phone, but got no response. Most likely because from their website it appears they only deal with the dealers and businesses, and not the consumer. So, since our capacitor, that Maitz Home Services had installed failed after only being installed just under 3 years ago, I had contacted Maitz Home Services through email for a refund of the failed defective part. After a week long of attempts with Maitz Homes Services Service Manager, Ken Monaco and President, Dave DeWalt to get a refund for a failed defective part that carries a 5 year warranty which failed in just less than 3 years, I was realizing I am not getting anywhere with their understanding my stance. They told my wife the part was expensive and would cost $394.00 and billed us that cost, as noted on our bill. The part failed in less than 3 years and the part is covered under a warranty for 5 years. They insist they will not refund the cost of the part. Instead they want to refund their service fee and diagnostic fee. I told them the service call and the diagnostic was not what failed, the Universal Motor-mate capacitor they installed was what failed and is covered under warranty. I would like to ask you for help in my getting a refund for the cost of the failed defective part, $394.00.
