Ranch Pony Cyndi Constance Sold us an unbroke and unsound horse Houston, Texas

We purchased a horse from Cyndi Constance, ranchpony.com Here is a copy of the internet description of the horse we bought: "This guy is gentle and slow and fearless on trails. Very smooth at all his gaits. Walks and trots easily. He needs pushed to lope. This is great for beginners because he doesn't just take
off unless you want him to. Rides naturally with his head low and on a loose rein. Doesn't neck rein much but direct reins easily. He's picking up the neck reining quickly. This little guy will be a nice ride and friend for somebody." We took him to the vet the day after we bought him because he had a cough and started limping. The vet said the horses' hooves were trimmed too short, had a hoof infection and shouldn't be ridden until it was treated and healed. I called Cyndi and she told us he had a cough when she bought him, but she didn't give him all of his antibiotic, so we should get some more antibiotic from our vet and give it to him and he should be fine. She also said sometimes her husband trims the horses hoofs a little short, but that the horse would be fine. It took a couple of weeks for the hoof to heal. After the hoof healed, my daughter got on the horse and it started bucking. She was not able to stop the horse or get it to stop bucking. The horse buck from one end of our property to the other end and would not stop bucking. She finally lost her balance and fell. She broke her back and pelvis. She is in her twenties and grew up riding horses. I can not imagine what would have happened if a beginner had tried to ride this horse. I called Cyndi and told her what happened and asked when we could bring the horse back and trade for another horse. She has a policy that she will do that. She also told me in person when we picked up the horse, that if he didn't work out, she would return my money minus $500.00 or we could trade for another horse. I was within 2 days of her money back policy. She told me that because the horse bucked she would have to send the horse to her trainer which would cost money, so she could take him back or trade him! We had the horse for a total of three weeks. Ranch Pony is a horse trading business and now I know they only keep horses they sell for a short amount of time. They do not keep them long enough to know the horses they sell and certainly do not care about customers! Please do not use this company to purchase a horse. The horse we bought was not as described and the person who got bucked off will suffer pain for the rest of their life due to this horse. Please do not do business with this company. They misrepresented themselves and that horse to us and almost got someone killed!

I am greatly saddened and disturbed by these comments. It is unfortunate that people cannot take responsibility for their actions and choose to misrepresent the facts to harm others. Accidents happen in many sports and we all wish we could participate without ever having a problem.

The claim was made that his was an “unbroken and unsound horse.” To quickly answer these claims we have attached a video of this horse when we owned him nearly a year ago and an email from this person where she stated he passed his pre-purchase exam and she was really enjoying him.

Cathy, We enjoyed working with you and honestly told you when you wanted to see horses that we had that we did not feel were appropriate for you for at least a year from the time you lived in Cypress and your move to Waco. You bought other horses from other people in between that did not work for you too. Cathy’s husband who is a very experienced rider tested our horse. Cathy also rode the horse in our pasture and trails. We told Cathy he was lazy and would rather walk and trot and it is even stated on the video. She said that was perfect for her. We did demonstrate that the horse would lope and her husband loped him too. We gave her a 14 day unconditinoal, fully refundable trial period and allowed a vet check with her vet.

Please read the emails from Cathy below. Cathy admitted he only bucked once and she and her own trainer admit it was probably their fault. She said her daughter bailed off the horse when it came to the barn. Cathy listed "Concerned Parent" as the author of this report but by the quoted emails has said he would be the perfect horse for her if she couldn't get over her fear. This
"Concerned Parent" also repeatedly asked us to sell the horse or trade it back for her. She was confident in buying another horse from us until we told her we would need to charge her to send to our trainer for over a month to make sure this horse would not repeat his behavior. I would not sell it right away after any problem, whether it was the horse’s fault or the rider. We would need more time to evaluate him after this issue.

August 11, 2010 - "He did pass his prepurchase exam."... "Thank you again for all the time you have spent with me. When it comes time for another horse (maybe for Ralph), we will let you know.

Cathy did call us to tell us that she had been riding and Yeller was everything that she wanted. Her daughter came to ride and claimed he bucked and ran toward the barn. She bailed off the horse and was hurt. She did not blame the horse and even sent him to a trainer to make sure, and her emails repeatedly state the trainer never had an issue with him.

The next email we received was 12/21/2010 -

"I bought "Yeller" from you (we call him Sunny). We have had a trainer work with Sunny and he has been great. He thinks we either had the back girth too tight on him or he just wasn't use to having one at all. We have had no more bucking and I feel like he is solid and ready to go. If you know of anyone who wants to buy him let me know."

"Would you consider buying Sunny (Old Yeller) from us for $1500? If not, what price would you consider? We paid $2000 for him. He has not given us any trouble, and I've even taken him to a trainer and had no problems. He does great over trail obstacles and isn't fearful. He walks and trots great. He is very hard to get to lope, he doesn't buck, he just doesn't really know how to lope, so he does a fast trot. If my daughter had not had a problem with him, which we all think
it was her fault, he would be the perfect horse for me. I just can't get over my fear.

Cathy has asked us to sell her other horses too since then. She now seems to be unhappy and does not want to accept responsibility to sell her own horses.

Catherine listed "Concerned Parent" as the author of this report but by her own words in the quoted emails she said he would be the perfect horse for her if she couldn't get over her fear. This "Concerned Parent" also repeatedly asked us to sell the horse or trade it back for her.

There are always two sides to every story, but the facts above, based upon Cathy’s own emails do not support her false claims and libelous accusations.
