Shadyhill pups Helen Shelly Not refunding my money HIAWATHA, Kansas

I sent Ms. Shelly a $100 deposit on March 12, 2010, the deposit was for a Papillion puppy. The puppies were born on Aug. 17, 2010, on September 14, 2010 I sent a cashier's check for the remainder of the amount; the amount was for $950. On September 17, 2010, I received an email from Ms. Shelly stating that she received the full payment. On October 5, 2010 I sent an email to Ms. Shelly to see how the puppy was doing, she then responded to my email and told me that the puppy passed away. She said that she was sorry and that she would refund me the full amount. I had waited a week and there was no money in the mail, I then proceeded and emailed her to see when I could expect the refund. Days go by and no response to my email. I then called her home and her answering machine came on, I left her a message. Next day I call her again, no answer, I then called her on her cell phone; she answered her cell and told me that she was headed home from a trip to KY. I asked her about the refund, she said when she got home from her trip that she would send me the money. Another week goes by and nothing in the mail again. I emailed her again to check on the status of the refund, and days go by and no response to any of my emails. I then decide to call her again; I could clearly see at this point that she is trying to avoid me. I call her up and ask about the refund, and she tells me the same thing, that it's going to be in the mail. I then proceed to tell her that, if she doesn't refund my money that I will have no choice but to seek legal actions. She then got upset, yelled at me that she had no money and hung up on me. I then at that moment sent her a email (Oct. 22) about that conversation, I told her that I just need her to communicate with me and tell me what's going on and not leave me in the dark, if we need to work out a payment plan then that would be fine. She then was receptive and said yes, that she would appreciate that. She said the middle of the month works best for her; I agreed that it would be fine. Well, the middle of November comes and goes and still no refunds no partial payment, no anything. I send her another email on Nov.27; she responds that she will have the money the next day because she was selling a Yorkie. The first week of December comes & goes and still no money in the mail. I sent her an email on Dec.3 & Dec. 5th and still no response from her. I am now submitting a complaint to the BBB.
