South Bay Expressway Fraudulent Toll Evasion Citation San Diego, California

I received a citation from South Bay Expressway telling me I evaded a toll. Gave me the date and time. My wife was driving my car at the time. We went to our financial institution to get a report (since we always use our card at the toll booth). The bank told us we were charged twice withing a six minute period and that the second one was returned to us by SBX. We submitted out our request for an investigation complete with a printout of the charge on the date in question. We have since received the results of that investigation and are still told we are in violation and that they will grant us a one time waiver and only charge us $3 for the toll (which was already paid for that day) and a $10 fee to recoup their processing and collection costs. The letter also stated that I had to pay within 7 days of the date of the letter. It took 3 days for the letter to get to us...locally. So now I have 1 day, since they aren't open on the weekends to get this taken care of or they threaten me to the DMV and extort an outrageous fine. I don't feel as though I should have to pay for their system error. I feel as though they need to put in a receipt option for those that pay at the booth. I feel as though they are fraudulently hitting people with these bogus fines to try and recoup money lost when the builder went bankrupt. I hope there is a lawsuit, class action or otherwise, so they will stop their illegal and shady practices. Depending on the outcome of when I talk to them monday, I am more than likely to report this to the local news stations who do investigative work for the little guy who gets bullied around by big companies.
