APX alarms recently changed names to Vivint, probably to hide their bad name. I purchased an alarm service with the company in 2007 under the verbal agreement with the salesperson of a two year contract. After numerous problems with the service in the first few months I called to have it cancelled and pay off the two year balance. At that time I was told that it was a five year commitment and that they would only cancel if I paid the balance or suckered some other poor soul into taking over my contract. I continued to pay ( and am currently still doing so to protect my credit) even though I have not had the alarm service in almost four years. I have called many times over the years trying to get these vampires to stop sucking the life blood out of me and recieved the same old tired response of transferring my account to somebody else. What a racket and what a scam. If you are dissatisfied with this companies service, you then have to become a salesman of their product to get out from underneath them. Morally I am unable to recommend a product that I wouuld never use again to somebody else. Financially, I would rather give the remaining balance of the contract to a good lawyer than to pay them another dime for a service that has never been rendered. Do yourself a favor; use a different alarm company and read the fine print on any contract so you do not end up in the same position that I am.Somebody making you pay for something you never receive would be considered a crime in any other realm outside of corporate business.

I also have the same problem with these people... Was told it was a 2 year contract and without realizing it till a few days later find out it was a 5 year contract. Their new name sounds like a porn site and no where on their new sign does it mention that they are a security company or home protection of any kind. Oh vivint... that will really scare away a thief. Also... APX at least sounded like a security company and I did not sign with vivint... would have never signed with a company called vivint. Can we cancel our contract for this reason alone? I am getting a lawyer. |

I signed up for a 3 year contract with Vivint. After fulfilling the contract I called to cancel and was advised that I had to submit cancellation in writing 30 days before the contract ended. Since I wasn't aware of this they automatically renewed my contract for another year and I wasn't allowed to cancel until the year was finished. The cancellation fee would be the amount that they would have charged for that additional year of service (about $540).
Here's how I was able to cancel, it took a solid two hours of arguing with different workers at Vivint. On our first contract it stipulated under "Term for Services" that vivint will, "provide you with written notice of the renewal not less than sixty days no more than one hundred twenty days prior to the end of the original term or any renewal term." If you have this in your contract and they didn't send you the letter, they are in breech of contract and you should be allowed to cancel.
My renewal offer conveniently had this part removed (I had to renew my contract when we moved because I hadn't fulfilled the first one therefore giving me two seperate contracts). On my second contract each paragraph states 60 months of service. We signed up for a three year contract (36 months) and the sales man crossed out the 60 months on the contract (which I'm sure is part of the sales pitch) but forgot to cross it out under the "Terms of Service" paragraph therefore making that entire paragraph no longer legitimate since we were signed up for 36 months. Because of this the written notice 30 days before cancellation clause was no longer in effect for us and we were able to cancel by phone at any time.
This is how we got out of our contract and I hope it works for you too. It is a shame that customers fulfill their three year contract and are then bullied into another year. I think this business is questionable to say the least in its dealings with customers. |
