Forensic Mortgage Loan Audit Scams: A New Twist on Foreclosure Rescue Fraud
Fraudulent foreclosure rescue professionals use half-truths and outright lies to sell services that promise relief to homeowners in distress. According to the Federal Trade Commission (FTC), the nations consumer protection agency, the latest foreclosure rescue scam to exploit financially strapped homeowners pitches forensic mortgage loan audits.

In exchange for an upfront fee of several hundred dollars, so-called forensic loan auditors, mortgage loan auditors, or foreclosure prevention auditors backed by forensic attorneys offer to review your mortgage loan documents to determine whether your lender complied with state and federal mortgage lending laws. The auditors say you can use the audit report to avoid foreclosure, accelerate the loan modification process, reduce your loan principal, or even cancel your loan.

Nothing could be further from the truth. According to the FTC and its law enforcement partners:

there is no evidence that forensic loan audits will help you get a loan modification or any other foreclosure relief, even if theyre conducted by a licensed, legitimate and trained auditor, mortgage professional or lawyer.
some federal laws allow you to sue your lender based on errors in your loan documents. But even if you sue and win, your lender is not required to modify your loan simply to make your payments more affordable.
if you cancel your loan, you will have to return the borrowed money, which may result in you losing your home.
If you are in default on your mortgage or facing foreclosure, you may be targeted by a foreclosure rescue scam. The FTC wants you to know how to recognize the telltale signs and report them. If you are faced with foreclosure, the FTC says legitimate options are available to help you save your home.

Spotting a Scam
If youre looking for foreclosure prevention help, avoid any business that:

guarantees to stop the foreclosure process no matter what your circumstances are
instructs you not to contact your lender, lawyer or credit or housing counselor
collects a fee before providing any services accepts payment only by cashiers check or wire transfer
encourages you to lease your home so you can buy it back over time
recommends that you make your mortgage payments directly to it, rather than your lender
urges you to transfer your property deed or title to it
offers to buy your house for cash at a fixed price that is inappropriate for the housing market
pressures you to sign papers you havent had a chance to read thoroughly or that you dont understand.
Finding Legitimate Help
Housing experts say that when youre behind on your mortgage payments, maintaining communication with your lender is the most important thing you can do. Contact your lender or servicer immediately if youre having trouble paying your mortgage or you have received a foreclosure notice. You may be able to negotiate a new repayment schedule.

I was solicited by American Home Savers because a notice of default was filed. They say that if I pay $3, 000 to Royal Korp Alliance, they will quarentee that they can postpone the "sale" at least 8 months. If I supply them with all the paperwork ie, 1003 Loan App, title, loan docs etc... they will run a ferensic test and see if the lender made any mistakes 5 years ago. They then will file a legal action (I have to pay for the filing fee $300-400) and that will slow down the lenders ability to get my house. The two entities they report are Consumer Education Network @ 900 W, 17th St Ste.D Santa Ana, CA.92706. Also the Royal Korp Alliance, UBI # XXXXX which says that they will refund my prepaid fee if I don't get at least 8 months. I searched the companies and agent names and it was all dead ends or pay money to get reports. BBB said none were listed with them. Google was little help. I smell a rat but the paper work and names and a copy of the law suit(with names redacted) could be plausable. The guarentee looks fraudulent with some cheap seal and a spelling error. This sounds like "60 Minutes" material. I'm a real estate broker for over 37 years and I have helped people to get loan modifications(no charge) but I generally get the listing for the short sale if I cannot get them modified. I've done at least 9 of these short sales and I hear all the scams from everyone. This is a new one to me. Any pre-paid fee deal is dubious. Michael Freiburger Thanks

So if I understand correctly, American Home Savers are asking you to pay to Royal Korp Alliance?

31 days and 16 hours ago. Customer Reply Actually I would make a check payable to Consumer Education Network. They give all the paper work to Royal Korp Alliance Inc., which runs the audit to see if there were any errors on loan docs, MERS etc. Then they will write up the suit that is to be filed. I get that and file it and pay the fee approx300-400 and that then ties up the lender for 8-12 months. Even if Aurora Loan Services, did everything right and they do have the right to file the "NOD" (4-25-11) it is my assumption that they will not be able to hold the Trustee Sale until the issue is resolved. American Home Savers is just the middleman. AMS did say that a less pendis would be filed? I know that means a legal action is pending but is that another fee or is that considered the action they will give me to file. SideNote: I'm looking at the Royal Korp Alliance membership application. Simple questions, name, SSN, date of birth etc. then at the bottom... disclaimers and signatures, it says "All fees paid to Royal Korp, Consumer Education Network and its Affilates (affilates is spelled that way on their form) are non refundable. Royal Korp guarantees to delay the sale of your property."In the 2 page guarentee letter it does say" RKA will implement and execute a stay for a minimum of 8 months" Are we having fun yet? They do seem to be legitimate companies, but this is simply too convoluted. Although I cannot point to any fraud in the past, I would strongly advise not to go through with this - this simply smells fishy here. I would pass.

THANK YOU for posting this!!! We are in dire straits with our home and were contacted by "Eugene Goldman" of First Family Justice Center. What we were told and then presented were totally different so we passed on sending in monies after reading the contract, which looked like a cheap, plagiarized copy written/edited by a high schooler. People who prey on the weak and scared have no sense of morality or humanity. I hope this post will save other homeowners the last of their money.

You are an idiot if you give these crooks one penny. They did absolutely NOTHING for us but take $2500 and give us false hope and promises. A new "specialist" handled our account EVERY time we called. No address listed--Red Flag! Not registered with CA D.R.E.--Red Flag!! Owners and ties to other organizations with VERY questionable backgrounds--WHO ARE NOT LICENSED--RED FLAG!!!
