In response to your explanation of scam vs. disagreement, there is no need to explain the difference between the two. I believe your consumers are smarter than you think. Let me correct you Minocqua USA, according to the Merriam-Webster Dictionary Online, a scam is defined as "a fraudulent or deceptive act or operation". Furthermore, the Free Online dictionary defines a scam as "a stratagem for gain; a swindle. vb scams, scamming, scammed. (tr) to swindle (someone) by means of a trick." If you are going to seek definitions, please do not use those that suit you and the purpose for which you are defending your argument and illegal strategic practices to swindle customers out of their hard earned money. I bought two HTC Wildfire S phones on July 5th and 8th at your company; however, Mr. Sergio Mendez was informed early on about the defects of the phones. He behaved nonchalantly about the matter and stated the phones are new and come from the manufacturers. He told me to reset the phones to their original settings and this would fix the problem. Well, we did. He stalled so long with giving an immediate solution that now I have received this e-mail content: "Thank you for your email. My RMA department did receive your package. Unfortunately the package did not have no paperwork attached to it. They did advise it said attention Sergio Mendez but that was all the information provided. You were sent an RMA repair form for this unit with the instructions on how to send your device to us. I did receive your previous email in regards to a refund on this unit, unfortunately due to the time you have had the unit, we will need to send the unit to repair. In regards to your refund, this information will need to be forward to my director and he will advise how we can proceed. I would like to inform you that an evaluation will need to be completed on this unit, in order to move forward. This can take anywhere from 8-10 business days. Once my RMA department has completed this evaluation, you will be contacted. Thank you for your time, if you have any questions feel free to contact us." What a scam?! I am not sure what is most appalling to me - the nature in which they scam or the arrogance in the e-mail that they send to customers. I spent 298.90 and 298.79 total cost for phones that are clearly defective. Their policy is in fine print and in a section where no-one can find in their website. An honest company will not have to hide their policy. It is beyond my understanding and ludicrous for a company to expect for their clients to notice any defects or technical issues with the phone in 7 days. The fees are ridiculous as well as the time frame to inspect the devices (3 to 4 weeks). Mr. Mendez's response was as follows: I do apologize to hear about your loved one. Unfortunately we will need to have the devices sent out to repair. We calculate 3-4 weeks due to the fact that the unit will take anywhere from 3-5 days for you to send it to us and then another 3-4 days for the unit to arrive to the repair facility. We do not need your sim card, only the device itself. As far as the refund, this order is past the seven day return policy, we can issue the Buy Back program on these devices, once the units are repaired. I will provide you with the store policies below. Please let us know how you would like to proceed. We would really like to get this issue resolved for you but please understand the procedures needed to complete your RMA. RETURN POLICY: If you are unhappy with your purchase, you may return the unopened item within 7 days for a refund/credit; minus a 5% restocking fee (excludes "open box" items) based on the list price of the item. If you choose to "Refuse Delivery" of your item there were be a $25.00 refusal fee in addition to a 5% restock fee of the list price of the item. All opened/unused items are subject to a restocking fee of up to 15% of the list price of the item; used items are subject to a 15%-45% restocking fee of the list price of the item based on usage, condition, accessories, and packaging (also applies to returned "open box" items). If you are unhappy with your purchase after 7 days, your return is subject to our "Buy Back Policy". A store credit will be issued for your return based on the usage of the device, the exterior condition of the phone, the condition of the packaging, and the accessories attached or included. If you would prefer to receive a refund (instead of a store credit), you may opt to, however, the refund amount is typically less than the trade in value for store credit your item would receive. Typically returns/refunds are processed within 10 days of receipt." I am very angered and tired of these scamming and fraud companies who prey on their customers. I have contacted the bank and will proceed to follow the chains of command. To resolve this matter, I have let the bank know of their scheme and have recorded conversation as well as e-mails concerning this company. I will refuse to pay for defective devices and will not held responsible for the companies negligence to assist me when I was advising them of the defects of the phones. How can you define a scam vs. a disagreement? There is no disagreement...the company scams customers and their policy is, not to be redundant, ridiculous. I encourage all buyers who have had issues with this company to file a report and contact the BBB to cease them from scamming customers.
