I applied for a job at Rincon Filing Services aka Rincon Management. The ad in Craigslist said they have 7 offices with 20 more pending. There were in fact several offices in the building, all with different names. They usually had some sort of filing serice in the name to make people believe they could file lawsuits. I met with John Cook who offered me a job immediately. He said it was commission only employment. Although I knew that the job did not meet the conditions for an independent contractor status, with the amount of commissions that he was offering, and that people stated they were earning, I decided it was worth it. I went to work the next day. and sat with someone to train. She stated that the first person we were to call was the debtors employer and then call the relatives next. She called the employer and asked to speak to the immediate supervisor of the debtor. She informed the debtors boss that a process server was coming to the place of employment to serve a summons on the debtor because legal action was being taken. If the manager asked what it was about, she said she did not know if it was civil or criminal. She was just the process server. In order to divert the summons from the place of work the manager was to give the debtor the phone number to the legal office and the case number. The employer always gave it to the debtor. If the company did not want to cooperate, then they were to say that it was illegal for them to interfere with a process server and they could be liable for a criminal offense. When the debtor called the "legal office", the phones were in the same room, just a different group of people. Those people threatened the debtor with a lawsuit, threatened to garnish their wages, take their house and car if they did not pay up. They added on collection fees and fake court fees that tripled or quadrupled the amount if they went to court and offered to settle for a lot less, but only if they settled that day. A lot of people fell for it. I heard some people telling debtors that they were the sheriffs department, that a "uniformed officer" would be out to serve them, and they curse them and called them names. Everything about their practices was in violation of the Fair Debt Collection Practices Act. This was the sleeziest crew I had ever seen. About half of them had multiple facial piercings. Some of the women wore booty shorts and had their boobs hanging out. The rest were just people who had fallen on hard times and would take any job. I don't think anyone realized that what they were doing was illegal. Since it was commission only, a lot of them were making little to nothing. The guy sitting next to me had worked the first month and got nothing. The people who were making all of the money were John Cook's family and buddies. He gave the new work to them and gave everyone else old files and dribbled a little new work to them. If they quit before a month was over, then he got everything they collected and they got paid nothing. He was essentially getting his old files worked for nothing. Most people quit within a few days to a few weeks. The turnover was unreal. This guy is being investigated by the Corona police who are sending files to the FBI. If he offers you a job, stay away. You could be caught up in legal problems. I quit really fast.

What happens if we're the victim? Is this true? Do we need to pay the debt amount? The sent me a Offer of Settlement letter via e-mail, and the rep told me to sign it and send it back to them ASAP. After reading this I'm contemplating on turning it back in. She even has my mastercard information to debit for 6 months, but she says I need to sign this document 1st.

I have a friend that works for this company and I considered working for them too which is why I am researching their company and replyimg to this right now. I sat in their office the past 2 days and am now trying to make a decision whether or not I want the job.
I will agree that they are not the "classiest" group of people but I did meet a few people that came from living in tiny apartments that are making a good living now and supporting their families. That's not a crime because they are doing what is legally allowed!
I agree that they are hounding on people for money BUT I can say that the debts are real and these people really do owe them this money. I realize that these people might be in tough situations but I also know that whatever I decide to charge on a credit card I have to pay back. No one gets off for free and it's their own fault.
Bottom line- it might not be the job for me (or for you) but it's a strong company. Not everyone can collect debt because you have to be a jerk kinda cuz these people don't want to pay up!

This is completely legal..and all true, yes you we own your debt, yes you will be served, and yes you will be taken to court.Our company has lawyers and if your debt is in stats..you better be careful what you say because i will send your case number to corporate and have them really serve you and take you to court.so if you want to take your chance, then hey be my guest, but the people i work for will get their money.goodluck!

It's not legal you moron, and you can not claim to be capable of taking legal action against anyone.If you have any questions of the legality of Rincon and their practices please go to the federal trade commissions website and check out exactly what is and is not legal when collecting debt. While you're there, file a complaint against Rincon. Knowledge is power.

“The FTC wants to remind debt collectors of their responsibilities and obligations under the law. Abusive collection actions are illegal, and if debt collectors use abusive tactics they could face legal action, ” said David Vladeck, Director of the FTC’s Bureau of Consumer Protection. “At the same time, we want consumers to understand their rights if their debts go into collection. Money matters, and the more people know about managing their debt and dealing with debt collectors, the better off they will be.”

According to the FTC’s complaint, filed by the Department of Justice on the FTC’s behalf, the defendants participated in, or controlled, the actions of debt collectors whose unlawful practices included false or deceptive threats of garnishment, arrest, and legal action; improper calls to consumers; frequent, harassing, threatening, and abusive calls; and unfair and unauthorized withdrawals from consumers’ bank accounts. The complaint also alleged that the defendants failed to adequately investigate consumer complaints or discipline collectors, and collectors who were terminated for violating the Fair Debt Collection Practices Act (FDCPA) often were rehired within a few months.

07.01.2011 don't mess with a Texan
If you get a call from a firm sayinf they are Union Filing Servce in Corona, California and they are serving you with a law suit for a bad debt don't sweat it. Here is their drill--my call was placed to a relatives land line phone and I was told I had a incoming call from some one. Person on phone wanted to lnow if my name was-----1st mistake I made was to give them my name---then I was asked if I would be home later in the day to accept papers from a process server for a bad debt. I told the person I would be home. I was instructed to call 1-866-767-8814 and was given a case #..Was told if I did not called withn an hour the law suit papers wpuld be served to me at my home later in the day. Called the # I was given. Some one answered the phone with "hello" and I had to ask who I had reached and who I was talking to. After giving them the above info I spoke supposedly with a George Wallis whom I am quite sure is an a.k.a name. He proceded to tell me they had already tried to servce me with a warrant 45 days ago--tried to serve it twice--no one ever knocked on my door trying to serve a warrant. I am a virtual shut in and I am seldom gone from my home. Wallis wanted me to pay $681.50 asap to stop the law suit but was more than vague about giving me info that I could verify about this so called bad debt.By now I knew I was dealing with a real "trying to be" scam artisr. Would not tell me the name of the County that the law suit would be filed in nor could he decide if it was already filed with the Court or if it was still in pending stage. Some poeple can't lie very well especially if you are making up your script as you go along. Long story short. This firm uses many, many names. To name a few Narional l Filing Service, Portifilio Recovery Service, Rincon, Global Filing Servuce, City Mangmnt. There are about 20 firm name they go by. and when you call to speak with them there are so many phony names. Countless phone numbers byt they all ring at the same place. There mailing address is: 1181 Magnolia Avenue #D 396 Corona, California 92879. They will rell you that is where "Corporate: office is located. Lies--it just so happens this address is no more than a building housing UPS mail boxes. The FBI and the State Attorbey Generals Office as well as the Corona Police Depy. are all very well aware of what goes in with these people. Read, and research. Arm your self with all the lnowlege you can get in reference to what these people attempt to do. They work on scare taticts and intimidatation of peope; who really do owe outstanding bad debts. I must end this poset but I just wanted to post what I have experienced at the hands of these people. I will be happy to tell you where you can het lots of good info on thiis situation if you reply to my post. Pay your just debts but you do not have to pay a penny until the so called debts you owe are validated in writing withing. When a firm/individual threatens to file suit against you they must send you a letter within 5 days from the inital contact date of the debt.They must state in their letter that you have you have 30 days from the date you recieve the letter to respond requesting that the debt be validated to your satisfaction also they must state that you have these 30 days to dispute this debt before any Court proceedings take place. You can't get a judgement in Court unless you can prove that you have served the debtor of intent to sue. Fight them don't be intimated. That is what they are counting on.
