The following is a laughable matter that occurred and a disinterested "judge" who disallowed further discussion on a VERY important matter. The Facts: -August 31st, 2010, appx
1030PM. I am pulled over by Badge 3830. -I was told I was speeding. -I just left a fire at my Fiances
house, this can be verified by Fire Chief , 763-767-6429, Coon Rapids
City Hall, 11155 Robinson Dr. Coon Rapids, MN 55433. -Badge 3830 tailed me for 22:09:03 to
22:09:16, 99 miles per hour at 22:09:05.
90 mph at 22:09:08. Clocked at 73mph when lights finally go on at 22:09:16. -74 mph when I first put on my
blinker. I immediately pulled over. - I shared that I just came from a house fire and I was told,
well maybe you should slow down. -I presented my license and insurance
and waited. -Badge 3830 returns with a Citation.
I reiterated that I just came from a expletive house fire. This was the point where I was told well maybe you should slow down. I put the citation on my dashboard and said thank you officer and rolled up my window. - I immediately called Robbinsdale
police at appx 1038PM, 763-525-6215. I speak to an officer, id myself and badge 3830 and ask to issue a complaint. I am told a Sgt will call me back, Sgt Foley. -1113PM sgt Foley calls me. I explain
incident and 3830s EXCESSIVE SPEED and length of time tailing me. I am told to come in and complete a Complaint Form at 4101 Hubbard Ave N, Robbinsdale, MN 55422 between 7AM and 11PM. -on September 1st 2010, I
visit Robbinsdale Police Dept and file a Citizen Complain Form against Badge 3830 and his aggressive pursuit of myself. I present this and then leave the premises. -9-2-10,
831am, sgt gary guck calls me. he does not understand my complaint. i tell him it is that 3830 almost rammed me and did not ID self with his lights. sgtr tells me his officers are trained to not put on lights so people do not get away. i agree that thats fine but 3830 almost hit me! also, 3830 did NOT note on the citation notes that i had mentioned just coming from a house fire, which i told him and can be verified by coon rapids fire department. sgt guck tells me that the video for the squad only goes on 10 seconds before the stop. sgt foley had told me 20 seconds. whichever it is, i look forward to viwewing it in court. sgt guck says he will speak with a captain and someone will be back in touch with me. i give sgt guck my cell which is a better number to reach me at. i reiterate that i as a driver, am not trained as officers are, so when i see a car speeding RIGHT on my tail, i do hit the gas. i tell Guck that just a few days prior my supervisor at work got rear ended by a drunk driver at 90 MPH. i must tell the truth, this is what was going thru my mind as i viewed my rear view. i feared for my safety. no citizen should wonder if a speeding car behind them is a drunk driver, a criminal, or a maniac. i was afraid for my safety. -Officer Kaczmarek Sergeant Gary Guck Robbinsdale Police Department 4101 Hubbard Ave N Robbinsdale, MN 55422 763.531.1220 From:

Sgt Guck. you were incorrect about badge 3830 being 2 car lengths away from me and turning on his lights after tailing me for 7 seconds .Also, my speed was 72 not 76 while your stand up officer was racing at 99 mph with red hot chili peppers
blaring on his radio!. He was LESS than ONE car length away, and was riding me for at least TEN seconds before identifying himself with police lights.
Although your officers may be trained to tail someone before putting on lights, at TWO car lengths (which NEVER happened) we, the general public, are not trained to react to such aggressive behavior, and a car approaching us at
NINETY NINE MPH! Have badge 3830 turn down his blaring Red Hot Chilli Peppers on his radio and get a clue as well as some understanding especially after someone has a house fire, which he mentioned NO WHERE on the citation although that was the FIRST
thing I told him. I wonder why he did not cite that accurate, audible info on the citation? Standard procedure for
your officers to omit important information? Badge 3830 was text book in this incident? what kind of text book are you using? I don't think it is safe in the least! Ive set up court for December and i look forward to going over the dash cam of how Badge 3830 prefers to intimidate the general public by all but rear ending a citizen. I just wanted to make you aware of your miscalculation. Surely it was a miscalculation, or were you lying? You said in several years you have NEVER heard a citizen say an officer of yours has ever tailed too closely. Review the tape. it is obvious and i have ZERO years police experience. Have a nice day. Questions for Mr. K: 1.Were you listening to Hard Rock Music prior to pulling me over, namely, Red Hot Chilli Peppers, as audible on City of Robbinsdale Certified Copy of your stopping of my vehicle on 8-31-2010 (no, play video). 2. Do you recall how fast you were travelling prior to pulling me over? And for how long? 3. How long are you trained to tail a vehicle before identifying yourself? At what proximity are you trained to tail a vehicle before identifying yourself? 4.Are you aware that your Sgt, Sgt Gary Guck shared that you tailed me for 7 seconds before identifying yourself, and that he had no problem with this. 5. Are you aware that you were actually tailing me, on 8-31-10, for 13 seconds, a difference of 6 seconds, verifiable on the submitted video, at a HIGH rate of speed, unidentified this whole time, at one point peaking at 99mph, before identifying
yourself? 6. Would you say that this is a safe practice? Would you say this is standard operating procedure, as it were, taught and approved by your employer? 7. Would you agree that tailing a moving vehicle, on hghwy 100, at 99mph, unidentified for 13 seconds, could possibly be dangerous? Would you agree that a car tailed in this manner could be intimidated, afraid, resulting in slamming on their breaks or increasing their speed, which in this case, the Defendant did do? 8. Your honor, this type of aggressive driving is unsafe, intimidating, and could have resulted in serious injury or death. It was un necessary and what a shame it would have been if a routine traffic stop would have resulted in my car being read ended at 99mph, spinning out, and a possible casualty. No further questions your Honor. Ladies and Gentlemen, boys and girls, this is outrageous. Furthermore, I go into Court today and the lovely "judge" Margaret A. Daily is presiding. Her disinterest in public safety leads me to write to the Board on Judicial Standards. Here that letter is: Hello Board on Judicial Standards, 4-21-2011 I am filing a complaint against Judge Margaret A. Daily. Today, Thursday, April 21, 2011, I went to 4th Judicial Court, I was here to explain my absence from court on March 10, 2011. I had started a new personal planner and failed to enter that date to my
new planner. I am aware this is not a great explanation. But it is true. And I have taken off work the last two Thursdays, the 14th and 21st of April, 2011 to come to Court. This has always been important to me This was about a speeding violation, alleged, but it is about so much more. It is about an Officers very, very dangerous conduct. Today, Ms. Daily only wanted to hear why I missed the initial Court time.
She shot down my request to read a brief statement on some pertinent facts of a traffic stop in which I was in court for, regarding an officers conduct. When I pressed her and asked her if she was indeed not interested in the fact that Robbinsdale Police officer, Mr Kaczmarek, almost rear ended me due to an allegation of my speeding, she did not care to hear this. I shared that this man was driving 99 mph at a poiint, tailing me for 13 seconds, contrary to Sgt. Guck sharing he was only tailing me for 7 seconds before identifying himself with his lights, leading me to fear for my safety as I did not know who or why someone was almost hitting me. Police video shows this rate of speed and length of time in which Mr. Kaczmarek conducted himself. My point is this: I was almost rammed by a squad car. For an allegation of speeding, which I contest. Ms Daily is a joke and you can tell her that X said this. She is not interested in hearing matters of right and wrong. This was a public safety matter and now, due to not liking my reason for why I missed court, despite the fact that I am here, two weeks in a row, in a suit and tie, taking work time off from Social Work, but she does not want to hear it? I am thoroughly confused. Ms. Daily is an obstruction to justice and I want this heard and noted. She said, I advise you to stop in regards to my sharing some details, since I was being denied an opportunity to share facts that she was surely not aware of, and the Prosecutor was ignoring, if at all aware. I have Robbinsdale Police Video showing this officers actions. How he was listening to aggressive rock music before speeding up and almost ramming me. Not acceptable. And none of this will be viewed due to Ms Dailys abuse of her position. Unbelievable. I will be seeking a lawyer to pursue Mr Kaczmarek and addressing his conduct. Second to this matter, please take note of my complaint of Ms. Daily. Just think: What if this aggressive officer continues his behavior? Sgt. Gary Guck does not see a problem with his conduct. What if Mr Kaczmarek were to continue this behavior and hit someone? Almost rear ending someone you THINK is speeding? Really? The risk is worth it? Really? What if this individual were to hit Ms. Daily? What a shame. She could have assisted in making a difference. Instead, she continues to listen to DWI cases and grant them probation, all the while listening to their stories, yet denying mine. Wow. Very interesting. Ms. Margaret A. Daily, you are a shame and utter joke to the title Judge. If you are interested, I can get you an application at McDonalds. Board on Judicial Standards, thank you for your time. General public, be careful.
Some people in positions of power, "officers", "judges", flat out wrong "prosecutors" are exhibiting behaviors that are detrimental to the safety, rights, and trust we should have. This is not acceptable. These individuals should be held accountable. I have remained calm, professional, and have come with the facts. Yet I have been denied.
Because I did not have a lawyer?
Because it is easier that way?
Because some people may be in cahoots with other people?
Garbage.
You have made your decisions, denied me an opportunity to make this situation right, and now, I take pride in my right to post these FACTS here, where they cease to be my property but now Ripoffreport's property. Hope you are all satisfied with yourselves and your failure to "serve and protect".
In the mean time, I will watch my back and stay aware of my rights, and have video readily available.
