We recently sold our home in Parker, Colorado and moved to a new home only 5 miles away in Parker, Colorado. On or about November 9, 2011 We received an email and quote from John at “Professional Moving and Storage” (see exhibit 1). In this email and attached quote (see exhibit 2), John from Professional Moving and Storage quoted us a price of $1,873.00 for two days of packing and moving with 2 trucks and also stated “we will only bill you for the time that the movers are actually working - we usually attempt to slightly overestimate just to cover all contingencies.”
We were subsequently in our opinion fraudulently charged a total of $4,259.00, a difference of $2,386.00 above and beyond what we had agreed to pay, and we were not provided the services promised. Additional costs for damages and cleaning were also incurred.

Total: $4,259.00 Additional costs we incurred, not normally part of a "professional move":
Cleaning of toilet mess, floor and carpet stains left by movers $450.00
Damage to landscaping and Sprinkler system estimate $950.00
Damage to trees - $275.00
Total Additional Costs: $1,675.00The Professional Moving and Storage only spent 1 and ½ days packing/moving, only provided 1 truck instead of two, and did not finish moving all items or providing all contracted services, (requiring me to move over 26 pickup truck loads myself without reduction in the quoted amount as promised). We also suffered significant damage to our landscaped yard, sprinkler system, two trees, carpet, bathroom and required professional cleaning services due to the negligence and/or careless actions of the movers employed by Professional Moving and Storage.Detail: A physical and visual walkthrough of the house and items was conducted by John at Professional Moving and Storage prior to providing the estimate. We were told that we could also reduce the amount of the move by packing and moving some items ourselves if desired. The pack and move of all items was estimated by John to take 2 days, and would include 1 day of packing and 1 day of moving with 2 trucks, tentatively scheduled for Dec. 1 and Dec. 2, 2011. It should be noted that prior to the movers arrival on Dec. 1, we had already packed and moved the entire garage contents, master bedroom closet, and completely packed all items in two bedrooms, two storage rooms and the entire basement, minus one basement bedroom and bath (and moved approx. 8 pickup truck loads). On or about Dec. 1, the movers hired by Professional Moving and Storage showed up at approximately 9:30-10am, instead of the 8:30am time promised, claiming delay due to the weather. There was snow actively falling, with 1-3 inches of snow on the ground. On their initial approach up our driveway, the driver of the first truck was driving too fast for conditions and slid the truck off of the driveway onto our landscaped yard. **It should be noted that the driver of the second truck had no problems coming up the driveway immediately afterwards, neither did a separately contracted piano mover, nor did myself or several other friends/helpers have any difficulty driving up or down the driveway throughout the entire 2 days of the move. While this may be unusual weather for Texas, it is certainly not unusual for Colorado, and I would expect Professional movers to be accustomed to dealing with it in a professional manner. The driver tried unsuccessfully to pull the truck off the yard and back onto the driveway, damaging the yard and eventually digging the tires down deep enough to damage the sprinkler system in the process. Two trees were also damaged by the movers. (see exhibits 3 and 4). This truck was stuck and unusable throughout the entire move process, even though the entire team (and other contracted piano movers, and myself attempted to free the truck). An additional 2nd truck for the move was never provided, even though we were charged for it. I suggested they should hire a tow truck to pull their truck out, but they declined stating they did not want to pay for one. The movers wasted approximately 3 hours move time in trying to free the truck using various methods at various times throughout the day which they later charged us for. They did pack several rooms this day, and used one truck to move some of the items. When they finished for the day, at approx. 7pm, the team lead Thomas stated that the amount that would be charged was quite a bit over what had been quoted. He asked us to sign a document stating that we agreed to the additional amounts. I asked why we were not advised or asked if we wanted to authorize additional amounts prior to work being done. Thomas threatened that if we did not sign it, they would not return to finish moving the large heavy items the next day, and that this was just to show that he had been there. Thomas stated that we would have to argue the amounts with John, that perhaps they would take off some of the time, and or truck charges, but that if we didn’t sign, he wouldn’t come back the next day. We signed the document, stating that we did not agree to the amounts, or change from the quote. On Dec. 2, The movers arrived at approximately 9:30am. Thomas again used duress to force us to sign a document releasing them from responsibility for the yard damage, and agreeing to pay for up to 6 hours of work on Dec. 2 or they would not move any of the heavy, big items. I complained that we really had no choice at this point that I felt they had withheld moving the majority of the big, heavy items until the 2nd day, knowing that we could not move them ourselves, nor contract another mover in the short time period. I stated I had difficulty reading the handwritten document, Thomas stated, well I will just read it to you, and Thomas again threatened that if we did not sign the release document, they would not move anything and leave us sitting there unable to move. I signed the document, again stating that I disagreed with the previous days move charges, and that while I would authorize the 2nd day hours, I still felt the 1st days were unreasonable, and beyond the agreed amount and that all charges should come in under the quoted amount. The movers tried unsuccessfully to pull the stuck truck out with their other truck for approx. 30 minutes (see exhibit 6-8), started moving the heavy/big items at approximately 10:00am, delivered, and stopped moving at approx. 11:45 am on Dec. 2, using only one truck, with less than 3 hours spent moving on Dec. 2. Sometime during the move, one of the workers filled the guest toilet of the bathroom with his excrement, plugged up the toilet and left it full of his excrement and floating turds and failed to clean or notify anyone. It went unnoticed until it had festered for two days. (see exhibit 5). The movers also failed to put any type of protective covering on the floors or carpet as most professional movers do leaving the floors and carpet full of tracks and stains. A professional cleaning service was required to clean the mess and stains left by the movers at an additional cost of $450.00. I later had to finish the move with the assistance of friends and family later that day by moving a total of over 26 Pickup truck loads of items that were not moved or packed by the movers. (see exhibit 9-13) The movers later contracted a tow truck to remove their stuck truck from our yard. The tow truck driver was upset upon our arrival, stating he had been waiting quite some time for the movers to show up so he could pull the stuck truck out. We offered to allow him to move the truck, but he stated that he had to wait for the movers to show up and authorize/pay. The movers showed up approx. 30 minutes later and the tow truck driver pulled the stuck truck out without any further damage after waiting 5 minutes for us to finish loading our pickups with additional items.Just a small part of the 26 pickup loads they did not complete moving as promised in their quote: Phone calls to John, Brad, Thomas, and Sabrina Duran at Professional Moving and Storage were made on numerous occasions beginning on Dec. 1 thru Dec. 8 in an attempt to come to some reasonable agreement. While initial calls with John and Brad on Dec. 1 and 2 prior to completion of move were ambiguous and left us thinking we would be able to stay at or within a reasonable amount of the quote, subsequent calls were heated. I was even called names by Thomas. Even though they readily admitted that only one truck was ever provided for the move, that several hours were wasted or overbilled during the move, (at one point they offered taking off 2 hours, or taking off the 2nd truck fees), they failed to bring cost down to the quoted amount or reimburse for any of the damage or overbilling.We ended up having to cancel our Credit card, dispute the bill with Visa, and file complaints with the Colorado Department of Regulatory Agencies (DORA), the Better Business Bureau (BBB), and any other sites we have been able to find in order to warn others not to fall for the same ruse that we did.What do you think?
