Countrywide They ripped us off and added 10 years to our morgage and payments went up and added $25,000 to morgage Heartland Internet, Texas

My husband and I purchased a house in 2008 in Heartland,Tx. The morgage company was Countrywide. After we got our first tax statement we realized that something was really wrong. the had only included $777 for an undeveloped lot to our escrow and our tax bill was $4100. We contacted Countrywide and spoke with a gentleman by the name of Marcus Hill. we faxed him all of the information he needed to modify our loan. In the mean time we continued making payments. This was in June of 08'. We waited to hear from him for two months and we got no calls. So I decided to call him and he said that he couldn't find our paperwork and we needed to fax it again, so we did. At that time it was November of 08'. He told us not to make any payments because everything would be rolled in to the modification. When we didnt hear back from him by the end of December, I got nervous and made a payment. He told us that the modification was final the end of January 09' and our payments would be $1274 a month but our loan had to be extended 10 years to a 40 year note to get that payment. so we trusted him and signed the papers. when we got our first statement for March 1st it said our payments were $1998. I called him immediately and he said he never told us our payments woul be that amount.


we could not afford that amount and on top of that 10 extra years. This took our total morgage fro $131,990 to $138,990. we tried getting in contact with someone at the bank that could help us and finally talked to someone in escrow that transfered money from principal to escrow to lower our payments to $1475.


Then the end of May when I called to make a payment, they asked if we would like to see if we could qualify for the Making Home Affordable Plan. The lady said it could really lower our payments. So, ofcourse I said sure and faxed her all of the documentation she needed. She said she would contact me and let me know what to do next. I waited until the end of June to hear from her and I called to see what was going on.


when I called, some incompetent person had misplaced our paperwork and sent it to the wrong department and never got it to the right department. They then went back and looked at the modification that Mr. Hill did and took that amount of $1998 and the $1475 that we had been paying and took the difference and sent the house into forclosuer and never told us anything. By the time we found out, we already had a seel date. I called almost every day to try to figure out what to do and no two people could give me the same answer. They told me so many different stories and I was so afraid we were going to lose our house.


They told us that we could not make any payments while the house was in foreclosure but they were trying to see if they could get us into a modification program. Finally in Jan. 10 we finally were put into a modification process and our trial payments were $1374.20. We paid them every month by Western Union so we would have receipts to show for our payments. Then in June the said that we didn't qualify for that modification so they were going to put us into the HAMP backup modification program . We continued making the same payment of $1374.20 until we got the papers saying that we qualified for that modification. They said that our payments would be $1339 a month but our loan would still be for 39 years. They only lowered our payments by $40 and the term of 40 years by 1 year.


the girl I talked too said that I should just be glad that we didnt have to pay all of the payments that we didn't pay. I told her that they told us we couldn't pay those payments. The papers said that we would pay our first payment on Oct. 1st for $1339 but we still had to keep paying all of the payments for each month until then as well. I called and asked where that money was going and they said it would be applied to what we owed.


I couldn't understand that because if the loan was starting all over, everything should be rolled in. I made the first payment on Oct. 1st and we just recieved a letter saying that the payment for October that I made was a misc. posting and listed as other unapplied on the statement. The statemant said we owed $1403.75 for Oct. and for Nov. and they were charging us fees in the amount of $2,103.17. On top of that, we now owe $155,876.63 on our morgage.


We have been trying to get this figured out but it keeps getting worse. I just feel like we have been ripped off. I thought modifications wer supposed to lower your monthly payments so you could better afford your home and keep it. It just seems like they are making it worse. The payments were only lowered by $40 a month and now we owe an outragious amount on our home. I still don't know if the are going to try to forclose on us.


We have two children that are in elementary school and my husband has also had some health problems tha have reall been hard to deal with this year so if anyone can help us, please help us. I just don't know what else to do.
