On 18th August 2009 I purchased a Trojan F32SF boat called the “Badger” from Mr D J Stabelfeldt through a broker Mr R Erisman of Atlantic Yacht Brokers for the sum of US$23,000.00 I had two surveys done on the boat, the hull by Jones Marine Surveyors & Consultants, Inc. and the diesel engines and mechanical parts by Mr D Giannone of Complete Marine 1031 NE 27th Terrace, Pompano Beach, Fl 33062, both the surveyors found no great faults and offered no reason not to purchase the boat at the above price, both surveyors said it seemed a good deal and were surprised the boat was in as good condition for the price. Part of the purchase agreement was that I could for 3 months leave the boat at Mr D J Stabelfeldt moorings, however the day after purchase I was informed that the boat had to be moved and the broker Mr R Erisman & his assistant Mr M Speciale accompanied me to move the boat to a mooring near to Mr D Giannone of Complete Marine who was to service the boat before shipping the boat to the Commonwealth of Dominica W.I. On that trip after 30 minutes of running, the port gear box (the New One) “Blew up” and stopped working. Mr D Giannone examined the port gear box and said it needed a rebuilt transmission, cost $3250.00 plus fitting, Mr Giannone stated that the cause of the gearbox failure was the gearbox controls were faulty and not engaging the gear box correctly. Mr Giannones company did the gearbox replacement and other work, cost totaling $12,965.57 Mr r Erismans’s assistant Mt M Speciale did the rewiring of the control cables and the work was checked by Mr Gannone, the total cost of cable and other unrelated work was $5000. Mr Giannnone informed me that the works were completed and had been sea trialed to his satisfaction and I paid all the monies requested in full. I had decided that I would move the boat from Pompano area to St Petersburg Pasadena Marina. I employed a Coast Guard Captain Jerry Davis of St Pete area I had been warned that the boat’s steering was non operational and Captain Davis on the 29th October 2010 manoeuvred the boat on engines alone to the new work place of Mr D Giannone of Complete Marine. There a Complete Marine work crew replaced the steering ram and on the 30th Oct a Saturday on Double time at $210.00 per hour replaced the lower steering box with a steering box they said was not new but without faults and as new, plus other work which totaled $5730.03 We later found that all the work done on the lower steering box was done incorrectly as the hydraulic hoses were connected back to front and the steering on the lower position
worked back to front . Also the used steering box had to have all oil seals replaced as the ones in the box were old and leaking. We left Pompano yard and found a mooring on the intercoastal waterway for the night and on the 31st Oct set of for St Pete, that evening after having hydraulic problems all day with the UPPER steering station we moored in Sunset Bay Marina for the night. Captain Davis on the 1st Nov offered to replace the Upper steering box which he did without problem. All the time we were under way Captain Davis was aware that Mr Giannone had blamed the 1st gear boxes demise on the gear box controls and was checking that all was OK with the new ones. On the 2nd November
we left Stuart to go across country via lake Okeechobee to Fort Myers, as we entered the First Lock at Port St Lucie at approx 11 in the morning of 2nd November and the (new) gear box on the Port engine stopped working and Captain Davis had to maneuver on the starboard engine alone. At the Lock the Lock Master said that the best repair engineers around were at Indiantown Marina We proceeded to Indiantown Marina and Mr Bamberg came aboard the Badger and examined the port gear box. He said that the port gear box was no longer working and could not offer an explanation until much work was done to check what had caused the falure. He was asked if the controls were working OK and after checking said there was no problem with the controls! Mr Bamberg quoted approximately $11,000.00 to replace the port gear box Mr Bamberg then phoned Mr Giannone and had a discussion with him about the problem, Mr Gianonne blamed Mr R Erisman of Atlantic Yacht Brokers for not fitting the new gear control wires correctly. He was told that they were working fine and had not caused the gear box failure. Mr Giannone pointed out that the gear box was replaced by him in September / October 2009 and it was now November 2010 and only three months warrantee applied, however he offered to have the gear box examined if I sent it to him, but has never actually agreed how the box would be delivered to him or as he has said to Mr Bamberg lately,would pick it up “sometime”. On I believe the 3rd November 2010, Indiantown Marina went to remove Badger from the water with Mr Bamberg in command of the boat, Mr Bamberg tried to control the boat from the lower steering station and found that Mr Gannone’s had incorrectly fitted the lower steering box. The boat was put in the work yard and the new bear box was delivered the next day, however due to heavy work load at the yard it has taken some time to finish. I have lived aboard the boat as I am very short of money. I had to extend my time in Florida at a cost of an extra air ticket of $450.00until 29th November 2010 when I returned to the Commonwealth of Dominica W.I. where I live due to visa restrictions, the work on the gear box was not finished until I returned from Dominica on the 8th January 2011. Mr Bamberg of Indiantown Marina has stated that the cause of the port gear box failure fitted by Mr Giannone was due to not aligning the engine, gear box and propeller shaft when the replacement gear box was fitted in 2010 ( This checking of alignment of engine, gear box Indiantown Marina believe vital to the installation of any gear box installation) Mr Bamberg spoke to Mr Giannone by telephone and told him of his findings, Mr Giannone’s reply was that it was nothing to do with him, he or his staff did not check the alignment for gear box replacement and he would not
accept responsibility. The Only service I have received from David J. Giannone Inc. or Complete Marine of Pompano Beach Florida is exorbitant charges for the poorest quality of work
