On 9/23/10 we signed and submitted a partial application with EPS/LENNY CARDONE, to process checks thru EPS system.


On 9/30/10 we processed 40 checks thru EPS image system. In order to use the EPS system customer has to open 2seperate accounts with a maximum of $5000.00 ech. We had to submit 20 checks from each account. The following morning J/M received a tape on the scanner, nothing was processed. I called EPS and they assured me nothing was processed. I then told them to cancel, I would find another source for financing, I then called customer (Hudson) to verify his bank account had not been charged. He said none of the checks went through. I then informed him I was going to find another source for Finance, which he approved. We re-contracted the deal and customer made 1st payment to J/M Auto.


Five to six weeks later EPS started processing the checks. I called Lenny he said he needed proof. I then provided a copy of the customer bank statement where EPS had processed a check for $750.00 and attempted to process a fee for $265.57. Lenny insisted that nothing was processed on his end. On 11/20/10 we returned the scanner back to Northern Leasing, as instructed by Lenny. We received via fax a fraudulent contract signed by Lenny Cardone and R. Johnson Data Mgr. with falsified signatures. To date EPS is charging our account for services not rendered.

(we had to close our bank account.) Also customer informed me they attempted to charge their checking account again..

I was just informed about this recently otherwise i would have spoken up earlier...

JM Auto Sales did in fact try to run 1 deal but 2 separate accounts for one customer totaling 10k at the same time. Our program only allows a max of 5k per account but they figured they would manipulate the system and do 2 to 1 person at once. Regardless, now the customer will have to pay the full amount over 90 days period or they are going to have issues with a default. The customer was basically buried now because of JM Auto Sales being greedy and in no way was the customer going to be able to pay anything close to that. So right out of the gate JM Auto Sales wrote a bad deal... they were just thinking since the money was guaranteed whats the difference... basically screw us at EPS, JM Auto is going to get their money anyways. This is not the kind of relationship we want so it was a matter of time before they were shut down.

I personally showed them how to process checks and even went through a training session with multiple at the dealership and everyone there said it was "Easy and a No Brainer" I even helped wit marketing materials, banners ect...
After a customer writes out a number of checks that are equivalent to the payment dates and amounts they will only need to submit the first check for approval. the rest of the check are scanned in and stored in the system until the equipment will batch out at the end of the night. Keep in mind it is all done electronically so you need to have it connected to the phone line. The original transaction wont complete if they don't scan all the checks in, which was done, the had a final receipt showing the total of the transaction.
During the night the check reader tried to batch itself out but there was no phone line connected so the long receipt they seen in the morning was the check reader saying there was "no line" connected. So we manually entered all the checks into the system.
If the customers check bounces and returns for NSF we have a few days to try and collect the money from the customer before we release funds to the business (JM Auto Sales). No answers. no calls back and being hung up on by the customer only shows that the customer had no intention of paying us and seemed quite comfortable about keeping that attitude. After a series of Attempts and no help from JM Auto Sales we determined that it was a fraudulent deal and wanted nothing to do with it or JM Auto Sales. JM Auto Sales didn't care and wanted their money regardless. After a few days JM Auto Sales wanted to start over and assured us that it was just a coincidence that it was the first file and the customer wasn't paying. I already made sure the deal was cancelled in the system.
We at EPS gave them a 2nd chance but would watch them closely to make sure JM Auto Sales was telling the truth. during this time JM Auto Sales still has a customer out there with their car and no payments made. But the General Manager/Finance guy wrote the car deal up himself and gave the customer with a free and clear title on the car... no lien holder. I made it very very clear to not give anyone a free and clear title until all payments are made. I even tried to help with the customer to give the car back or start making payments. that's when the customer explained he was a friend of the GM and the GM told him that he would never have to make a payment because EPS would pay the amount to JM directly.

JM Auto Sales tried to run another deal through and decided to plug in the equipment to process the deal. the equipment would not let them input anything new but it still had the original checks stored in the system. Later on that night the equipment batched out what was stored in the system and went into a normal payment routine since there was a internal approval.
The customer thought that he was getting away with not paying and with a free car but our system was trying to ACH his account for the agreed said amount.
Now everyone is upset because the scheme they tried to get over on us backfired and resulted with NSF fees on their accounts... not to bright are they?

As far as falsified signatures... what a joke. The leasing company has JM Auto Sales on recording, which is part of the verification process, explaining each document they signed and that they knew all costs and obligations.

Sorry guys, you're just another Con Artist that tries to take advantage of people. Good Luck with your little care lot that's connected to a little gas station with no financing abilities. Buy here pay there is even a upgrade for you which you still cant afford to do with your 5 car inventory.
