|On August 27, 2010 I bought a KIRBY Vacuum Cleaner that was sold under HIGH PRESSURE SALES. I called my husband at work about this and let him talk to the salesman. My husband told the salesman to get out of our house. But after they hung-up the phone the salesman continued to use HIGH PRESSURE sales with me to let him stay and sell me a vacuum we did not need. I was told by the salesman that I had 3 days to return the KIRBY Vacuum if I did not like it. On September 1, 2010 I canceled my sales contract with KIRBY Vacuum and Metro Rhino Distributors as required by the terms of the contract and sent in the CANCELLATION NOTICE. I further sent in a Dispute to my Credit Card Company. On September 17, 2010 Metro Rhino Distributors picked up the KIRBY Vacuum. I received a letter from Paula Jackson, Customer Relations Senior Specialist, KIRBY Vacuum (800-494-8585 x5353). She stated that she was informed that the KIRBY Vacuum was picked up and we should give her a call to let her know the amount due from Metro Rhino Distributors. We stated in a reply phone message to her that the amount that Metro Rhino Distributors owes us is the sum of $1,926.00. My attorney also wrote a letter to Metro Rhino Distributors informing them that they were legally bound to refund my money in full. |
Since then my credit card company has informed me that the dispute has lapsed and there is nothing more they can do for me. I do not want to be responsible to pay for the KIRBY Vacuum that I do not have in my Possession. My attorney also called Metro Rhino Distributors to ask about the refund, Which they informed her that they indeed refunded the money..Todate November 12, 2010, 4:22pm, there has been no reverse charges. She also asked them for a letter to be sent to he to state that there was a refund. Also we got a call from Mr. Artis Webb and he left a voice mail saying he was going to make a reverse charge to our credit card. That was on November 8, 2010. As you can see from the statement above the Money has not been returned.

As of November 12, 2010 the sum still owed me is $1,926.00 which is a large sum of money to pay for when the product was picked up and returned. Furthermore Metro Rhino Distributors took my other vacuum and rug shampooer as a trade which has not been returned and I had to go out and buy new ones.
