I was contacted by David at risingstarmultimedia about re-building a website of mine. The site had been closed because the FTC filed charges against the web host. David told me he was "working with the FTC to help us re-coup the money we lost with this web host." He showed me a couple sites they had designed but he NEVER took me to his sites Terms and Conditions nor did he advise me to read over the Terms and Conditions before we continued. I thought that if I could re-coup the money I had invested that would cover the fee he was charging, so I agreed to his services. I never considered reading the Terms and Conditions since I was not instructed to do so at the time I agreed. David told me that he was going out of town for the weekend and would call me the following Monday. This was the 3rd Business Day. David did not call. I called the number he had given me and it went to voice mail. Fearing this was a scam, I left a message that I was CANCELLING his services and I wanted my money refunded to my PayPal account. I then contacted PayPal for a charge back and I contacted my credit card company and put the fee into dispute. When David was notified by PayPal of the charge back request he went 'ballistic.' He called my cell and left a rude message about how this was hurting his company and never offered an explanation of why he missed the phone appointment. He did say that he would "fight the charge back and he would win..." David did win. His company has kept my $2499.99 FOR NO SERVICES rendered. I refused to contact them and have them continue with the services due to David's rude and disparaging remarks. Also, because David LIED and denied that I ever contacted him or the company (since I was not aware that I had to cancel the service ON LINE...) and I believe he deleted the phone message I left. I filed complaints with the Better Business Bureau and the Attorney General's office. The CEO of RisingStarMultimedia, Darin Goldsberry, finally contacted me by email, stating that 'rather than have a disgruntled client, they would re-fund my $2499.99 if I would agree to sign a cease and desist order.' I replied to his email that I would agree to sign the cease and desist order if he agreed to refund my money in full. That was the last that I have heard from Darin Goldsberry or from RisingStarMultimedia. The BBB contacted me and said the company refused to refund my money and marked the case, "unresolved." In my opinion, this is the most unethical company that I have ever dealt with. I advise anyone looking for a Web Designer to stay as far away from this company as they possibly can! |
