On 7/29/10 I purchased '01 Toyota Solara SLE from TNT Auto salesman Roman Rodriguez. He explained in front of me and my in-laws that if I paid for the car in cash before 7pm he'd rather sell it to me than financing the car to someone else. So after several attempts of making a large cash withdrawal for 3700$ plus tax I was only able to come up with 1500$ cash. He then told me in front of the same witnesses that everything was ok now because he just didn't know that his debit machine was working again, because it hadn't been the day before. So I paid TNT $1500 in cash and then paid off the balance ($2,781.00) With my Debit. 30 days later i paid 310$ cash to Roman for my title and registration and plates. I was told the title would come in the mail. I know i may seem dumb now all of the signs add up to something obvious now, but my in-laws were there the whole time and a week later THEY BOUGHT A CAR for $2,000 cash from Roman Rodrguez. They too do not have a bill of sale or title for there vehical!
on 11/29/10 I reported my car stolen. I was later told by the police officer that my car had been REPOSSESSED by TNT President Zimmerman, and it was now a civil matter. ALSO he gave me a detective number because TNT was under investigation already for this scam. The cop even explained to me that they must of pocketed my cash and reported to there lender that i owed the missing money...sure enough the detective tells me over the phone he's looking at the title on the computer and he told me he sees my signature on the Title. I told him i never signed the title otherwise i would have took it with me. They told me that TNT is being investigated and they would prosecute Roman Rodriguez but they cant find him. So theres nothing i can do....So after trouble communicating with Detectives I called TNT Auto, President Zimmerman, He stated that his employee Roman Rodriguez copied peoples titles titles, forged his (Tom Z.) signature on titles for cars, and stole $350000+ from TNT." Tom Zimmerman is now taking back cars from all customers who bought from Roman Rodriguez. Zimmerman said, there is nothing I can do and there is nothing he will do, except get his cars back. He said "My ignorance in getting such a 'good deal' is my problem." Zimmerman says that Roman Rodriguez was an independent salesman so he is not responsible for his actions. Told me to contact Damen the lot manager for more information on the case.
His lot manager Damen at first wouldnt tell me who the lender was and who the repo company was. He said that he lost 30 cars and was going loose everything because Roman did this and he seemed to know that Roman had fled for Mexico. Though i do not see how he would be loosing anything seeing how they are repossessing these cars from the owners and selling them at a profit! Damen continued to treat me like this was all my fault, all the while admitting Roman R. was the one who ripped me and 30 other people off. I asked how i could accidently sign up for financing, without an answer. He said there was no way i would get my car back. I demanded to speak to the lender. ...Nothing...
Basically the lien they had on the title was phony, Federal truth in lending act states i have to sign off and agree upon any interest rates. And i never filled out financing papers. They never sent bills or even a final notice, I want to see the finance forms, and copies of my bill, and how much i owe on the lien on the title. (I've yet to get the title) and now my credit is ruined as well because of this. TNT is Auto sales and services, and there own lender, and repo company all in one.
I paid the car in full in July, never signed loan papers. Technically, TNT repo'ed the car cause he was robbed by his salesman AND because I never made payments to the bogus, forged loan. I absolutely thought the business was legit. I had no way of knowing his employee was a crook. Though they have the nerve to treat me like i did something wrong. This was my first purchase through a car dealer I never ever expected this to happen.
Damen plans to charge me for getting my personal affects and plates as part of the repo. He says I can not sue him. He says this is just like if I had bought a stolen car privately and the police confiscated it.
Now my credit is ruined. I would have never let that happen. the Repossessed it 3 months after i buy it??? Wheres the final notice even? They had the spare key to my car after they told me that they DID NOT HAVE A SPARE. and its a chip key only 2 keys in the world could open my car.
If a TNT salesman pocketed the 1500$ cash and forged financing papers to make me responsible for the missing money. how do I loose my car and my money? I have a bank statement at least, and registration in my name, all other papers are still in my car, which they said they cleaned out already. I bet it is already sold. How can this happen can someone please help me? Damen, the car lot manager, said that if my friend sold me a thousand dollar T.v. for one hundred dollars, the store would come after me and arrest me. He implied that i had something to do with it even though this guy was scamming people. I don't see how Roman would pocket money and go through all of the trouble of making me liable for the money so that TNT would be able to recover the car and sell it and still make profit.
Tom Zimmerman told me that my in-laws car will be repo'd as well in a matter of days. So they are now trying to get a hold of a copy of the title before that happens so that they can dispute Lien that's on it.
My credit is ruined I dont know how this could ever happen?
I would like a full refund, though I loved the car and would like to have it back. also i would just like my court costs paid for. I hope to shed light on this business as well as this type of fraud. I need help with finding help on what i should do though. Its just a sad situation i dont have a car to take my girlfriend to work, and i cant get to any jobs, were screwed now. somebody out there please help.
