Hi my wife's mom got a phone call the other day really early in the morning, it was from an attorney looking for my wife since we dont live with my mother in law, she call my wife really scared because the"attorney" made a huge deal of it, he was saying things like "so you dont know whats going on with your daughter" "she is big troubles but i cant tell you". The guy left a free phone number so my wife could call him back, wich my wife did right away, when my wife was talking to the attorney he was using a tone of voice really rude he had no manners at all, my wife is pregnant with about 2 months, well the attorney was saying that he was representing sears, and that sears want it the whole amount that we owe, wich was $5000, the attorney was saying that if she didnt pay right at this moment he was going to proceed with a lawsuit and that my wife was going to pay for the attorney fees, for court fees and all the extra fees, my wife was telling him that all we needed was just a little more time but we were gonna pay, and he kept saying that he was gonna seize my wifes property, in wich she is only secondary her mom is primary, so the guy kept telling her that if he brought the case to court we were looking to pay close to $10000.... at the end that guy threat my wife telling her that if didnt receive a phone call in two hours to pay he was gonna go ahead with the lawsuit. All this conversation left my wife crying and the whole night she couldnt sleep, i was so mad because she is pregnant that i started doing my research, I found that theres a law that prohibits collection calls threating consumers, the law is call FAIR DEBT COLLECTION PRACTICES ACT, wich states that a debtor doesnt have to pay more of the ammount he owes wich mean only the $5000, also prohibits harassing phone calls, or threating phone calls, or no creditor or collection can threat with garnishing wages or properties. Im gonna look for an attorney to sue sidney mickwell law firm, for damages to my wife and putting in danger my baby. base on what the FDCPA.
